SUMMARY: Makes a technical change to correct a drafting error
in legislation enacted last year related to a report of large
employers with employees who are enrolled in the Medi-Cal
Program. This measure contains an urgency clause.
The Senate amendments make technical changes to address
chaptering issues with AB 106 (Budget Committee) of the current
legislative session.
EXISTING LAW:
1)Requires the Department of Finance (DOF) to transmit an annual
report to the Legislature that lists the 500 employers in the
state with the most number of employees enrolled in the
Medi-Cal Program.

2)Defines "employer" for this purpose to mean an individual or
corporation that employs 100 or more Medi-Cal beneficiaries in
the state.
3)Authorizes the Employment Development Department (EDD) to
permit the use of specified information by DOF to prepare and
submit this report.
FISCAL EFFECT: According to the Senate Appropriations
Committee, pursuant to Senate Rule 28.8, negligible state costs.
COMMENTS: This bill merely corrects a drafting error to
legislation enacted last year.
AB 1792 (Gomez), Chapter 889, Statutes of 2014, required the
preparation of an annual report regarding employers in the state
with the largest number of employees who are beneficiaries of
the Medi-Cal Program. Specifically, AB 1792 required DOF, after
obtaining specified information from EDD, to annually transmit
to the Legislature and post on its Internet Web site a report no
later than the third week of January of each year beginning in
2016 that, among other things, identifies the 500 employers in
the state with the most number of employees enrolled in the
Medi-Cal Program, ranked by the number of those employees, as
specified.
The operative language of AB 1792 defined an employer as an
individual or organization that employs 100 or more
beneficiaries of the Medi-Cal program.
AB 1792 also amended Unemployment Insurance Code Section 1095,
which governs when and under what circumstances EDD may permit
the use of otherwise confidential information within its
possession. However, the amendment to that section mistakenly
defined "employer" to mean an individual or organization that
employs 50 (rather than 100) beneficiaries of the Medi-Cal

Program. Therefore, this bill would correct the drafting error
to Unemployment Insurance Code Section 1095.
This bill would also declare that it is to take effect
immediately as an urgency statute, necessary to provide clarity
to employers.
