An act to amend Sections 10621 and 10644 of the Water Code, relating to water management.

AB 149, as amended, Chávez. Urban water management plans.

Existing law, the Urban Water Management Planning Act, requires every public and private urban water supplier that directly or indirectly provides water for municipal purposes to prepare and adopt an urban water management plan and to update its plan once every 5 years on or before December 31 in years ending in 5 and zero, except as specified. The act requires an urban water supplier to submit to the Department of Water Resources a copy of its plan no later than 30 days after adoption and requires the department to prepare and submit to the Legislature, on or before December 31, in the years ending in 6 and 1, a report summarizing the status of plans adopted pursuant to the act. The act requires each urban water supplier to update and submit its 2015 plan to the department by July 1, 2016.

This bill would require each urban water supplier to update and submit its 2020 plan to the department by July 1, 2021, and would require the department to submitbegin delete its 2015end deletebegin insert theend insert report to the Legislaturebegin insert for the 2015 plansend insert by July 1,begin delete 2016,end deletebegin insert 2017,end insert andbegin delete its 2020end deletebegin insert theend insert reportbegin insert for the 2020 plansend insert by July 1, 2022.

The people of the State of California do enact as follows:

SECTION 1.  

Section 10621 of the Water Code is amended to

10621.  

(a) Each urban water supplier shall update its plan at
4least once every five years on or before December 31, in years
5ending in five and zero, except as provided in subdivisions (d) and
6(e).

7(b) Every urban water supplier required to prepare a plan
8pursuant to this part shall, at least 60 days before the public hearing
9on the plan required by Section 10642, notify any city or county
10within which the supplier provides water supplies that the urban
11water supplier will be reviewing the plan and considering
12amendments or changes to the plan. The urban water supplier may
13consult with, and obtain comments from, any city or county that
14receives notice pursuant to this subdivision.

15(c) The amendments to, or changes in, the plan shall be adopted
16and filed in the manner set forth in Article 3 (commencing with
17Section 10640).

18(d) Each urban water supplier shall update and submit its 2015
19plan to the department by July 1, 2016.

20(e) Each urban water supplier shall update and submit its 2020
21plan to the department by July 1, 2021.

SEC. 2.  

Section 10644 of the Water Code is amended to read:

10644.  

(a) (1) An urban water supplier shall submit to the
24department, the California State Library, and any city or county
25within which the supplier provides water supplies a copy of its
26plan no later than 30 days after adoption. Copies of amendments
27or changes to the plans shall be submitted to the department, the
28California State Library, and any city or county within which the
29supplier provides water supplies within 30 days after adoption.

30(2) The plan, or amendments to the plan, submitted to the
31department pursuant to paragraph (1) shall be submitted
32electronically and shall include any standardized forms, tables, or
33displays specified by the department.

34(b) (1) (A) Notwithstanding Section 10231.5 of the
35Government Code, and except as provided in subparagraph (B),
P3    1the department shall prepare and submit to the Legislature, on or
2before December 31, in the years ending in six and one, a report
3summarizing the status of the plans adopted pursuant to this part.
4The report prepared by the department shall identify the exemplary
5elements of the individual plans. The department shall provide a
6copy of the report to each urban water supplier that has submitted
7its plan to the department. The department shall also prepare reports
8and provide data for any legislative hearings designed to consider
9the effectiveness of plans submitted pursuant to this part.

10(B) The department shall submitbegin delete its 2015end deletebegin insert theend insert report to the
11Legislaturebegin insert for the 2015 plansend insert by July 1,begin delete 2016,end deletebegin insert 2017,end insert andbegin delete its 2021end delete
12begin insert theend insert report to the Legislaturebegin insert for the 2020 plansend insert by July 1, 2022.

13(2) A report to be submitted pursuant to paragraph (1) shall be
14submitted in compliance with Section 9795 of the Government
15Code.

16(c) (1) For the purpose of identifying the exemplary elements
17of the individual plans, the department shall identify in the report
18water demand management measures adopted and implemented
19by specific urban water suppliers, and identified pursuant to Section
2010631, that achieve water savings significantly above the levels
21established by the department to meet the requirements of Section
2210631.5.

23(2) The department shall distribute to the panel convened
24pursuant to Section 10631.7 the results achieved by the
25implementation of those water demand management measures
26described in paragraph (1).

27(3) The department shall make available to the public the
28standard the department will use to identify exemplary water
29demand management measures.
