An act to add Section 38511 to the Health and Safety Code, relating to greenhouse gases.

AB 239, as introduced, Gallagher. Greenhouse gases: regulations.

The California Global Warming Solutions Act of 2006 authorizes the State Air Resources Board to adopt greenhouse gas emissions limits and emission reduction measures by regulation to achieve the maximum technologically feasible and cost-effective reduction in greenhouse gas emissions in furtherance of achieving the statewide greenhouse gas emissions limit. The act authorizes the board, in the regulations adopted, to include the use of market-based compliance mechanisms.

This bill would prohibit the board, on and after January 1, 2016, from adopting or amending regulations pursuant to the act. The bill would authorize the board to submit to the Legislature recommendations on how to achieve the goals of the act.

SECTION 1.  

Section 38511 is added to the Health and Safety

, to read:

38511.  

(a) Notwithstanding any law, on and after January 1,
42016, the state board shall not adopt or amend a regulation pursuant
5to this division. The state board may submit to the Legislature
6recommendations on how to achieve the goals of this division.

7(b) This section does not affect the validity of regulations
8adopted before January 1, 2016.
