Existing law, known as the Donahoe Higher Education Act, among other things, sets forth the missions and functions of California’s public and independent segments of postsecondary education. A provision of the act expresses the intent of the Legislature that each resident of California who has the capacity and motivation to benefit from higher education should have the opportunity to enroll in an institution of higher education. This provision also expresses a commitment to provide an appropriate place in California public higher education for every student who is willing and able to benefit from attendance.

Existing law establishes the California State University, under the administration of the Trustees of the California State University, and the University of California, under the administration of the Regents of the University of California, as 2 of the segments of public postsecondary education in this state. The California State University comprises 23 institutions, and the University of California comprises 10 institutions.

SECTION 1.  

Section 66201 of the Education Code is amended
18to read:

(a) It is the intent of the Legislature that each resident
20of California who has the capacity and motivation to benefit from
21higher education should have the opportunity to enroll in an
22institution of higher education. Once enrolled, each individual
23should have the opportunity to continue as long and as far as his
24or her capacity and motivation, as indicated by academic
25performance and commitment to educational advancement, will

2requirements.

3(b) The Legislature hereby reaffirms the commitment of the
4State of California to provide an appropriate place in California
5public higher education for every student who is willing and able
6to benefit from attendance.
