Existing law provides for the licensure and regulation of health facilities, including general acute care hospitals, administered by the State Department of Public Health. Existing law authorizes the department to approve, as prescribed, a general acute care hospital to offer cardiac surgery and cardiac catheterization services, as defined, if specified requirements are met. A violation of these provisions is a crime.

This bill would require a surgical team for the performance of cardiovascular operative procedures that require extracorporeal bypass to consist of a minimum of 2 surgeons. Because a violation of this requirement would be a crime, the bill would impose a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that no reimbursement is required by this act for a specified reason.

No reimbursement is required by this act pursuant to
7Section 6 of Article XIII B of the California Constitution because
8the only costs that may be incurred by a local agency or school
9district will be incurred because this act creates a new crime or
10infraction, eliminates a crime or infraction, or changes the penalty
11for a crime or infraction, within the meaning of Section 17556 of
12the Government Code, or changes the definition of a crime within
13the meaning of Section 6 of Article XIII B of the California
14Constitution.

SECTION 1.  

Section 1255.5 of the Health and Safety Code is
16amended to read:

1255.5.  

For purposes of Section 1255, the following definitions
18apply:

19(a) “Cardiac catheterization” includes an intravascular insertion
20of a catheter into the heart for the primary definition and diagnosis
21of an anatomic cardiac lesion. For the purposes of this definition,
22the insertion of a Swan-Ganz thermodilution cardiac output
23catheter, a venous line, and a temporary pacemaking electrode
24catheter are excluded.

P3    1(b) “Cardiac surgery” means surgery on the heart or great vessels
2requiring a thoracotomy and extracorporeal circulation.

3(c) “Cardiovascular surgery service” means a program of a
4general acute care hospital that has the capability of performing
5cardiac catheterizations and cardiac surgery as defined in this
6section. Under no circumstances shall there exist in a general acute
7care hospital a cardiac surgery service without a cardiac
8catheterization laboratory service.

9(d) “Cardiac catheterization laboratory service” means a program
10of a general acute care hospital that has the capability of performing
11cardiac catheterization. Cardiac catheterization laboratory service
12does not include pediatric cardiac catheterization laboratory service.

13(e) “Pediatric cardiac surgery service” means a program of a
14general acute care hospital that has the capability of performing
15cardiac catheterization and cardiac surgery, as defined in this
16section, for the diagnosis and treatment of congenital defects in
17children. Cardiac catheterization for pediatric patients shall be
18performed only in a general acute care hospital that has the
19capability to perform cardiac surgery on pediatric patients.

20(f) “Intensive care newborn nursery services” means the
21provision of comprehensive and intensive care for all contingencies
22of the newborn infant, including intensive, intermediate, and
23continuing care. Policies, procedures, and space requirements for
24intensive, intermediate, and continuing care services shall be based
25upon the standards and recommendations of the American
26Academy of Pediatrics Guidelines for Perinatal Care, 1983.
