An act to amend Sections 82013, 82036, 82036.5, 84101, 84103, 84200.6, and 84218 of, to repeal Sections 84200.7, 84202.5, and 84203.5 of, and to repeal and add Section 84200.5 of, the Government Code, relating to the Political Reform Act of 1974.

Existing law, the Political Reform Act of 1974, provides for the comprehensive regulation of campaign financing, including requiring the reporting of campaign contributions and expenditures and imposing other reporting and recordkeeping requirements on campaign committees. The act requires elected officers, candidates, and committees to file various reports, including semiannual reports, preelection statements, and supplemental preelection statements.

This bill would recast the requirements for filing preelection statements and would repeal other reporting requirements, including supplemental preelection statements and supplemental independent expenditure reports.

The act defines “committee” as a person or combination of persons who receives contributions or makes independent expenditures of $1,000 or more in a calendar year or who makes contributions of $10,000 or more in a calendar year to or at the behest of candidates. The act defines “late contributions” and “late independent expenditures” for purposes of the act to include certain contributions and independent expenditures, respectively, that are made within 90 days before the date of the election.

This bill would revise the definition of “committee” by increasing the qualifying monetary thresholds to $2,000 for contributions received or independent expenditures made by a person or combination of persons or $20,000 for contributions made to or at the behest of candidates by a person or combination of persons.

This bill would revise the definitions of “late contributions” and “late independent expenditures” to increase the reporting threshold to $2,000 and to specify that those terms also include contributions and independent expenditures that are made on the date of the election.

The bill would also make conforming changes.

A violation of the act’s provisions is punishable as a misdemeanor. By expanding the scope of a crime, this bill would impose a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that no reimbursement is required by this act for a specified reason.

The Political Reform Act of 1974, an initiative measure, provides that the Legislature may amend the act to further the act’s purposes upon a 23 vote of each house and compliance with specified procedural requirements.

This bill would declare that it furthers the purposes of the act.

SECTION 1.  

Section 82013 of the Government Code is

“Committee” means any person or combination of
4persons who directly or indirectly does any of the following:

SEC. 2.  

Section 82036 of the Government Code is amended
8to read:

“Late contribution” means any of the following:

10(a) A contribution, including a loan, that totals in the aggregate

at which the candidate or measure is to be voted
17on. For purposes of the Board of Administration of the Public

19Board, “the date of the election” is the deadline to return ballots.

20(b) A contribution, including a loan, that totals in the aggregate

22to or received by a political party committee, as defined in Section

SEC. 3.  

Section 82036.5 of the Government Code is amended
26to read:

82036.5.  

“Late independent expenditure” means an independent
28expenditure that totals in the aggregatebegin delete oneend deletebegin insert twoend insert thousand dollars
29begin delete ($1,000)end deletebegin insert ($2,000)end insert or more and is made for or against a specific
30candidate or measure involved in an electionbegin delete within 90 days beforeend delete
31begin insert onend insert the date of thebegin insert election or during the 90-day period preceding
32the date of theend insert
election. For purposes of the Board of
33Administration of the Public Employees’ Retirement System and
34the Teachers’ Retirement Board, “the date of the election” is the
35deadline to return ballots.

SEC. 4.  

Section 84101 of the Government Code is amended
37to read:

84101.  

(a) A committee that is a committee by virtue of
39subdivision (a) of Section 82013 shall file a statement of
40organization. The committee shall file the original of the statement
P4    1of organization with the Secretary of State and shall also file a
2copy of the statement of organization with the local filing officer,
3if any, with whom the committee is required to file the originals
4of its campaign reports pursuant to Section 84215. The original
5and copy of the statement of organization shall be filed within 10
6days after the committee has qualified as a committee. The
7Secretary of State shall assign a number to each committee that
8files a statement of organization and shall notify the committee of
9the number. The Secretary of State shall send a copy of statements
10filed pursuant to this section to the county elections official of each
11county that he or she deems appropriate. A county elections official
12who receives a copy of a statement of organization from the
13Secretary of State pursuant to this section shall send a copy of the
14statement to the clerk of each city in the county that he or she
15deems appropriate.

16(b) In addition to filing the statement of organization as required
17by subdivision (a), if a committee qualifies as a committee under
18subdivision (a) of Section 82013 before the date of an election in
19connection with which the committee is required to file preelection
20statements, but after the closing date of the last campaign statement
21required to be filed before the election pursuant to Sectionbegin delete 84200.7,
2284200.8,end delete
begin insert 84200.8end insert or 84200.9, the committee shall file, by facsimile
23transmission,begin insert online transmission,end insert guaranteed overnight delivery,
24or personal delivery within 24 hours of qualifying as a committee,
25the information required to be reported in the statement of
26organization. The information required by this subdivision shall
27be filed with the filing officer with whom the committee is required
28to file the originals of its campaign reports pursuant to Section
2984215.

30(c) If an independent expenditure committee qualifies as a
31committee pursuant to subdivision (a) of Section 82013 during the
32time period described in Section 82036.5 and makes independent
33expenditures ofbegin delete oneend deletebegin insert twoend insert thousand dollarsbegin delete ($1,000)end deletebegin insert ($2,000)end insert or
34more to support or oppose a candidate or candidates for office, the
35committee shall file, by facsimile transmission, online transmission,
36guaranteed overnight delivery, or personal delivery within 24 hours
37of qualifying as a committee, the information required to be
38reported in the statement of organization. The information required
39by this section shall be filed with the filing officer with whom the
40committee is required to file the original of its campaign reports
P5    1pursuant to Section 84215, and shall be filed at all locations
2required for the candidate or candidates supported or opposed by
3the independent expenditures. The filings required by this section

6(d) For purposes of this section, in calculating whetherbegin delete oneend deletebegin insert twoend insert

8received, payments for a filing fee or for a statement of
9qualifications to appear in a sample ballot shall not be included if
10these payments have been made from the candidate’s personal
11funds.

SEC. 5.  

Section 84103 of the Government Code is amended
13to read:

15information contained in a statement of organization, an
16amendment shall be filed within 10 days to reflect the change. The
17committee shall file the original of the amendment with the
18Secretary of State and shall also file a copy of the amendment with
19the local filing officer, if any, with whom the committee is required
20to file the originals of its campaign reports pursuant to Section
2184215.

22(b) In addition to filing an amendment to a statement of
23organization as required by subdivision (a), a committee as defined
24in subdivision (a) of Section 82013 shall, by facsimile transmission,
25online transmission, guaranteed overnight delivery, or personal
26delivery within 24 hours, notify the filing officer with whom it is
27required to file the originals of its campaign reports pursuant to
28Section 84215begin delete whenend deletebegin insert ifend insert the change requiring the amendment occurs
29before the date of the election in connection with which the
30committee is required to file a preelection statement, but after the
31closing date of the last preelection statement required to be filed
32for the election pursuant to Sectionbegin delete 84200.7 orend delete 84200.8, if any of
33the following information is changed:

34(1) The name of the committee.

35(2) The name of the treasurer or other principal officers.

36(3) The name of any candidate or committee by which the
37committee is controlled or with which it acts jointly.

38The notification shall include the changed information, the date
39of the change, the name of the person providing the notification,
40and the committee’s name and identification number.

P6    1A committee may file a notification online only if the appropriate
2filing officer is capable of receiving the notification in that manner.

SEC. 6.  

Section 84200.5 of the Government Code is repealed.

In addition to the campaign statements required by
5Section 84200, elected officers, candidates, and committees shall
6file preelection statements as follows:

7(a) During an even-numbered year, all candidates for elective
8state office being voted upon in the statewide direct primary
9election or the statewide general election, their controlled
10committees, and committees primarily formed to support or oppose
11an elected state officer or a state candidate being voted upon shall
12file the applicable preelection statements specified in Section
1384200.7 or 84200.8. All elected state officers who, during the
14applicable reporting periods covered by Section 84200.7 or
1584200.8, contribute to any committee required to report receipts,
16expenditures, or contributions pursuant to this title, or make an
17independent expenditure, shall file the applicable preelection
18statements specified in Section 84200.7 or 84200.8. However, a
19candidate for an office that is not being voted upon in the
20November election, his or her controlled committee, and any
21committee primarily formed to support or oppose that candidate
22is not required to file statements in connection with the November
23election pursuant to subdivision (b) of Section 84200.7 unless,
24during the reporting periods covered by Section 84200.7, the
25candidate, his or her controlled committee, or any committee
26primarily formed to support or oppose that candidate contributes
27to any committee required to report receipts, expenditures, or
28contributions pursuant to this title or makes independent
29expenditures.

30(b) During an even-numbered year, all candidates not specified
31in subdivision (a) who are running for offices being voted upon
32on the first Tuesday after the first Monday in June or November,
33their controlled committees, and committees primarily formed to
34support or oppose those candidates or a measure being voted upon
35on the first Tuesday after the first Monday in June or November
36of an even-numbered year shall file the preelection statements
37specified in subdivision (a) of Section 84200.7 in the case of a
38June election, or subdivision (b) of Section 84200.7 in the case of
39a November election.

P7    1(c) All candidates for offices being voted upon on a date other
2than the first Tuesday after the first Monday in June or November
3of an even-numbered year, their controlled committees, and
4committees primarily formed to support or oppose a candidate or
5a measure being voted upon on a date other than the first Tuesday
6after the first Monday in June or November of an even-numbered
7year shall file the preelection statements specified in Section
884200.8.

9(d) During an election period for the Board of Administration
10of the Public Employees’ Retirement System or the Teachers’
11Retirement Board, all candidates for these boards, their controlled
12committees, and committees primarily formed to support or oppose
13the candidates shall file the preelection statements specified in
14Section 84200.9.

15(e) In an even-numbered year in which the statewide direct
16primary election is held on the first Tuesday after the first Monday
17in June, a state or county general purpose committee formed
18pursuant to subdivision (a) of Section 82013, other than a political
19party committee as defined in Section 85205, shall file the
20preelection statements specified in Section 84200.7 if it makes
21contributions or independent expenditures totaling five hundred
22dollars ($500) or more during the period covered by the preelection
23statement. A state or county general purpose committee formed
24pursuant to subdivision (b) or (c) of Section 82013 is not required
25to file the statements specified in Section 84200.7.

26(f) During an even-numbered year in which the statewide direct
27primary election is held on a date other than the first Tuesday after
28the first Monday in June, a state or county general purpose
29committee formed pursuant to subdivision (a) of Section 82013,
30other than a political party committee as defined in Section 85205,
31shall file the preelection statements specified in Section 84200.8
32if it makes contributions or independent expenditures totaling five
33hundred dollars ($500) or more during the period covered by the
34preelection statement. A state or county general purpose committee
35formed pursuant to subdivision (b) or (c) of Section 82013 is not
36required to file the statements specified in Section 84200.8.

37(g) During an election period for the Board of Administration
38of the Public Employees’ Retirement System or the Teachers’
39Retirement Board, a state or county general purpose committee
40formed pursuant to subdivision (a) of Section 82013 shall file the
P8    1preelection statements specified in Section 84200.9 if it makes
2contributions or independent expenditures totaling five hundred
3dollars ($500) or more during the period covered by the preelection
4statement to support or oppose a candidate, or a committee
5primarily formed to support or oppose a candidate, on the ballot
6for the Board of Administration of the Public Employees’
7Retirement System or the Teachers’ Retirement Board. A state or
8county general purpose committee formed pursuant to subdivision
9(b) or (c) of Section 82013 is not required to file the statements
10specified in Section 84200.9.

11(h) A political party committee as defined in Section 85205
12shall file the applicable preelection statements specified in Section
1384200.7 or 84200.8 in connection with a state election if the
14committee receives contributions totaling one thousand dollars
15($1,000) or more, or if it makes contributions or independent
16expenditures totaling five hundred dollars ($500) or more, during
17the period covered by the preelection statement.

18(i) City general purpose committees shall file statements as
19follows:

20(1) City general purpose committees in a city that has an election
21on the first Tuesday after the first Monday in June or November
22of an even-numbered year shall file the statements specified in
23subdivision (a) or (b) of Section 84200.7 for the six-month period
24in which the city election is held, if they make contributions or
25independent expenditures totaling five hundred dollars ($500) or
26more during the period covered by the preelection statement.

27(2) City general purpose committees in a city that has an election
28on a date other than the first Tuesday after the first Monday in
29June or November of an even-numbered year shall file the
30preelection statements specified in Section 84200.8 if they make
31contributions or independent expenditures totaling five hundred
32dollars ($500) or more during the period covered by the preelection
33statement.

SEC. 7.  

Section 84200.5 is added to the Government Code, to
35read:

84200.5.  

In addition to the campaign statements required by
37Section 84200, elected officers, candidates, and committees shall
38file preelection statements as follows:

39(a) All candidates appearing on the ballot to be voted on at the
40next election, their controlled committees, and committees
P9    1primarily formed to support or oppose an elected officer, candidate
2or a measure appearing on the ballot to be voted on at the next
3election shall file the applicable preelection statements specified
4in Section 84200.8.

5(b) All elected state officers and candidates for elective state
6office who are not appearing on the ballot at the next statewide
7primary or general election ballot, and who, during the preelection
8reporting periods covered by Section 84200.8, contribute to any
9committee required to report receipts, expenditures, or
10contributions pursuant to this title, or make an independent
11expenditure of one thousand dollars ($1,000) or more in connection
12with the statewide primary or general election, shall file the
13applicable preelection statements specified in Section 84200.8.

14(c) A state or county general purpose recipient committee
15formed pursuant to subdivision (a) of Section 82013, other than a
16political party committee as defined in Section 84205, shall file
17the applicable preelection statements specified in Section 84200.8
18if it makes contributions or independent expenditures totaling one
19thousand dollars ($1,000) or more in connection with the statewide
20primary or general election during the period covered by the
21preelection statements. However, a state or county general purpose
22committee formed pursuant to subdivision (b) or (c) of Section
2382013 is not required to file the preelection statements specified
24in Section 84200.8.

25(d) A political party committee as defined in Section 84205
26shall file the applicable preelection statements specified in Section
2784200.8 in connection with a statewide election if the committee
28receives contributions totaling one thousand dollars ($1,000) or
29more, or if it makes contributions or independent expenditures
30totaling one thousand dollars ($1,000) or more, in connection with
31the election during the period covered by the preelection statement.

32(e) A city general purpose committee formed pursuant to
33subdivision (a) of Section 82013 shall file the applicable
34preelection statements specified in Section 84200.8 if it makes
35contributions or independent expenditures totaling one thousand
36dollars ($1,000) or more in connection with a city election in the
37 committee’s jurisdiction during the period covered by the
38preelection statements. However, a city general purpose committee
39formed pursuant to subdivision (b) or (c) of Section 82013 is not
P10   1required to file the preelection statements specified in Section
284200.8.

3(f) CalPERS and CalSTRS Elections. During an election period
4for the Board of Administration of the Public Employees’
5Retirement System or the Teachers’ Retirement Board:

6(1) All candidates for these boards, their controlled committees,
7and committees primarily formed to support or oppose the
8candidates shall file the preelection statements specified in Section
984200.9.

10(2) A state or county general purpose committee formed
11pursuant to subdivision (a) of Section 82013 shall file the
12preelection statements specified in Section 84200.9 if it makes
13 contributions or independent expenditures totaling one thousand
14dollars ($1,000) or more during the period covered by the
15preelection statement to support or oppose a candidate, or a
16committee primarily formed to support or oppose a candidate on
17the ballot for the Board of Administration of the Public Employees
18Retirement System or the Teachers’ Retirement Board.

19(3) However, a general purpose committee formed pursuant to
20subdivision (b) or (c) of Section 82013 is not required to file the
21statements specified in Section 84200.9.

SEC. 8.  

Section 84200.6 of the Government Code is amended
23to read:

SEC. 9.  

Section 84200.7 of the Government Code is repealed.

(a) Preelection statements for the June election period
39shall be filed as follows:

P11   1(1) For the period ending March 17, a statement to be filed no
2later than March 22. However, for a special election called after
3March 17, or for which the period for filing nomination documents,
4as defined in Section 333 of the Elections Code, ends after March
517, a preelection statement for the period ending 45 days before
6the election shall be filed no later than 40 days before the election.

7(2) For the period ending 17 days before the election, a statement
8to be filed no later than 12 days before the election. All candidates
9being voted upon in the June election, their controlled committees,
10and committees formed primarily to support or oppose a candidate
11or measure being voted upon in the June election shall file this
12statement by guaranteed overnight delivery service or by personal
13delivery.

14(b) Preelection statements for the November election period
15shall be filed as follows:

16(1) For the period ending September 30, a statement to be filed
17no later than October 5.

18(2) For the period ending 17 days before the election, a statement
19to be filed no later than 12 days before the election. All candidates
20being voted upon in the November election, their controlled
21committees, and committees formed primarily to support or oppose
22a candidate or measure being voted upon in the November election
23shall file this statement by guaranteed overnight delivery service
24or by personal delivery.

SEC. 10.  

Section 84202.5 of the Government Code is repealed.

(a) Any candidate or any committee pursuant to
27subdivision (a) of Section 82013 which makes contributions
28totaling ten thousand dollars ($10,000) or more in connection with
29an election, including a runoff election, shall file a supplemental
30preelection statement no later than 12 days before the election, for
31the period ending 17 days before the election. This statement shall
32be filed by guaranteed overnight delivery service or by personal
33delivery with each office with which the candidate or committee
34filing the statement is required to file its next campaign statement
35pursuant to Section 84215.

36(b) This section shall not apply to candidates or committees
37during any semiannual period in which the candidate or committee
38is required to file preelection statements pursuant to Section
3984200.5.

P12   1(c) If a candidate or committee makes contributions totaling ten
2thousand dollars ($10,000) or more in connection with an election
3and all of those contributions are reported pursuant to Section
484200 or 84202.7 on or before the closing date specified in
5subdivision (a), the candidate or committee shall not be required
6to file additional statements for that period pursuant to this section.

SEC. 11.  

Section 84203.5 of the Government Code is repealed.

(a) In addition to any campaign statements required
9by this article, if a candidate or committee has made independent
10expenditures totaling one thousand dollars ($1,000) or more in a
11calendar year to support or oppose a candidate, a measure or
12qualification of a measure, it shall file independent expenditure
13reports at the same time, covering the same periods, and in the
14places where the candidate or committee would be required to file
15campaign statements under this article, as if it were formed or
16existing primarily to support or oppose the candidate or measure
17or qualification of the measure. No independent expenditure report
18need be filed to cover a period for which there has been no activity
19to report.

20(b) An independent expenditure report shall contain the
21following information:

22(1) The name, street address, and telephone number of the
23candidate or committee making the expenditure and of the
24committee’s treasurer, and the number assigned to the committee
25by the Secretary of State.

26(2) If the report is related to a candidate, the full name of the
27candidate and the office and district for which the candidate seeks
28nomination or election. If the report is related to a measure or
29qualification of a measure, the number or letter of the measure, or
30if none has yet been assigned, a brief description of the subject
31matter of the measure, and the jurisdiction in which the measure
32is to be voted on or would be voted on if it qualified.

33(3) The total amount of expenditures related to the candidate or
34measure during the period covered by the report made to persons
35who have received less than one hundred dollars ($100).

36(4) The total amount of expenditures related to the candidate or
37measure during the period covered by the report made to persons
38who have received one hundred dollars ($100) or more.

39(5) For each person to whom an expenditure of one hundred
40dollars ($100) or more related to the candidate or measure has
P13   1been made during the period covered by the report and for each
2person who has provided consideration for an expenditure of one
3hundred dollars ($100) or more during the period covered by the
4report:

5(A) His or her full name.

6(B) His or her street address.

7(C) If the person is a committee, the name of the committee,
8the number assigned to the committee by the Secretary of State,
9or if no number has been assigned, the full name and street address
10of the treasurer of the committee.

11(D) The date of the expenditure.

12(E) The amount of the expenditure.

13(F) A brief description of the consideration for which each
14expenditure was made and the value of the consideration if less
15than the total amount of the expenditure.

16(G) The cumulative amount of expenditures to such person.

17(6) A list of all the filing officers with whom the committee
18filed its most recent campaign statement.

19(c) Filing officers shall maintain paper reports filed pursuant to
20this section under the name of the candidate or measure supported
21or opposed by the independent expenditure.

SEC. 12.  

Section 84218 of the Government Code is amended

(a) A slate mailer organization shall file semiannual
25campaign statements no later than July 31 for the period ending
26June 30, and no later than January 31 for the period ending
27December 31.

9 shall file the statements specified in Section 84200.8 if, during the
10period covered by the preelection statement, the slate mailer
11organization receives payments totalingbegin delete five hundred dollars ($500)end delete
12begin insert one thousand dollars ($1,000)end insert or more from any person for the
13support of or opposition to candidates or ballot measures in one
14or more slate mailers, or expends five hundred dollars ($500) or
15more to produce one or more slate mailers.

16(c) A slate mailer organization shall file two copies of its
17campaign reports with the clerk of the county in which it is
18domiciled. A slate mailer organization is domiciled at the address
19listed on its statement of organization unless it is domiciled outside
20California, in which case its domicile shall be deemed to be Los
21Angeles County for purposes of this section.

22In addition, slate mailer organizations shall file campaign reports
23as follows:

24(1) A slate mailer organization which produces one or more
25slate mailers supporting or opposing candidates or measures voted
26on in a state election, or in more than one county, shall file
27campaign reports in the same manner as state general purpose
28committees pursuant to subdivision (a) of Section 84215.

29(2) A slate mailer organization which produces one or more
30slate mailers supporting or opposing candidates or measures voted
31on in only one county, or in more than one jurisdiction within one
32county, shall file campaign reports in the same manner as county
33 general purpose committees pursuant to subdivision (c) of Section
3484215.

35(3) A slate mailer organization which produces one or more
36slate mailers supporting or opposing candidates or measures voted
37on in only one city shall file campaign reports in the same manner
38as city general purpose committees pursuant to subdivision (d) of
39Section 84215.

P15   1(4) Notwithstanding the above, no slate mailer organization
2shall be required to file more than the original and one copy, or
3two copies, of a campaign report with any one county or city clerk
4or with the Secretary of State.

SEC. 13.  

No reimbursement is required by this act pursuant
6to Section 6 of Article XIII B of the California Constitution because
7the only costs that may be incurred by a local agency or school
8district will be incurred because this act creates a new crime or
9infraction, eliminates a crime or infraction, or changes the penalty
10for a crime or infraction, within the meaning of Section 17556 of
11the Government Code, or changes the definition of a crime within
12the meaning of Section 6 of Article XIII B of the California
13Constitution.

SEC. 14.  

The Legislature finds and declares that this bill
15furthers the purposes of the Political Reform Act of 1974 within
16the meaning of subdivision (a) of Section 81012 of the Government
17Code.
