This bill meets the criteria for referral to the Suspense File.
Bill
Summary: AB 609 would permit a candidate for the Legislature to
file a statement with the Secretary of State (SOS) voluntarily
agreeing that, if elected, he or she will continue to reside
within the district for which he or she was elected during his
or her term of office. Additionally, the bill would permit SOS
to post the statements on its website.
Fiscal
Impact: SOS indicates that it would incur a one-time General
Fund information technology-related cost of $55,000 to implement
the provisions of the bill.
Background: Current law requires a candidate for the Legislature to live
within the district he or she intends to represent for one year

immediately preceding the election. However, there is no
requirement that they must continue to reside there, once
elected.
Proposed Law:
This bill would do all of the following:
Permit a candidate for Member of the Legislature to file
a statement with SOS in voluntarily agreeing that, if
elected, he or she will continue to reside within the
district from which he or she was elected during his or her
term of office.
Provide that a person does not violate the voluntary
agreement if, after being elected for a term of office, the
boundaries of the district from which he or she was elected
are changed during that term of office so as to exclude his
or her residence from the district.
Require the statement be filed with his or her
nomination documents.
Require SOS to designate in the state ballot pamphlet
those candidates for Member of the Legislature who have
voluntarily agreed to the continuing residency requirement.
Staff
Comments: SOS would incur a one-time cost of $55,000 for related
modifications to its internet site.
