An act to add Article 8 (commencing with Section 60130) to Chapter 1 of Part 33 of Division 4 of Title 2 of the Education Code, relating to school finance.

AB 631, as introduced, Bonilla. School finance: Common Core and Next Generation Science Standards Implementation Fund Act.

Existing law requires the Academic Content Standards Commission to develop, and the State Board of Education to adopt or reject, academic content standards in language arts and mathematics that are internationally benchmarked and built toward college and career readiness by high school graduation, and requires at least 85% of these standards to be the common core academic content standards developed by the Common Core State Standards Initiative consortium or any association or related interstate collaboration, except as specified.

This bill would establish the Common Core and Next Generation Science Standards Implementation Fund Act, to be implemented if funds are received in the annual Budget Act or another statute, as specified. The bill would require the Superintendent of Public Instruction to allocate funds for the 2015-16 fiscal year to local educational agencies, as defined, on the basis of an equal amount per pupil based on the prior year’s enrollment for specified purposes relating to the integration of common core academic content standards, Next Generation Science Standards, and English language development standards in schools, including, among others, the professional development of teachers, administrators, and paraprofessional educators or other classified employees involved in the direct instruction of pupils that is aligned to specified academic content standards. The bill would require a local educational agency that receives funds to meet specified requirements, including reporting detailed expenditure information to the State Department of Education, and would require the department to summarize and submit the information to the appropriate budget subcommittees and policy committees of the Legislature on or before July 3, 2017.

The bill would require the Superintendent, upon appropriation by the Legislature, to allocate $900,000,000 to local educational agencies for purposes of implementing the act, and to allocate $1.1 billion to local educational agencies to satisfy outstanding claims pursuant to Section 6 of Article XIII B of the California Constitution for reimbursement of state-mandated local program costs for any fiscal year. The bill would express the Legislature’s intent that the local educational agencies use the latter one-time funds for the act’s purposes.

SECTION 1.  

Article 8 (commencing with Section 60130) is

60130.  

This article shall be known, and may be cited, as the
9Common Core and Next Generation Science Standards
10Implementation Fund Act.

60131.  

(a) For purposes of implementing the common core
12academic content standards, Next Generation Science Standards,
13and English language development standards adopted pursuant to
14Sections 60605.8, 60605.85, as that section read on June 30, 2014,
1560605.10, 60605.11, and 60811.3, as that section read on June 30,
162013, there is hereby established the Common Core and Next
17Generation Science Standards Implementation Fund. It is the intent
18of the Legislature that local educational agencies use funds
P3    1allocated pursuant to subdivision (b) to support the integration of
2common core academic content standards, Next Generation Science
3Standards, and English language development standards in
4instruction for kindergarten and grades 1 to 12, inclusive, for
5purposes of establishing quality instructional programs for all
6 pupils.

7(b) For the 2015-16 fiscal year, subject to subdivision (d), the
8Superintendent shall allocate funds to local educational agencies
9on the basis of an equal amount per pupil based on the prior year’s
10enrollment. The allocated funds shall be available for encumbrance
11through the 2016-17 fiscal year.

12(c) A local educational agency shall expend funds allocated
13pursuant to this section for any of the following purposes:

14(1) Professional development for teachers, administrators, and
15paraprofessional educators or other classified employees involved
16in the direct instruction of pupils that is aligned to the academic
17content standards adopted as specified in subdivision (a).

18(2) Integration of the common core academic content standards,
19Next Generation Science Standards, and English language
20development standards through technology-based instruction for
21purposes of improving the academic performance of pupils.

22(3) Instructional materials aligned to the common core academic
23content standards, Next Generation Science Standards, and English
24language development standards adopted pursuant to Sections
2560605.8, 60605.85, as that section read on June 30, 2014, 60605.10,
2660605.11, and 60811.3, as that section read on June 30, 2013,
27including, but not limited to, supplemental instructional materials
28as provided in Sections 60605.86, 60605.87, and 60605.88, as
29those sections read on June 30, 2014.

30(d) As a condition of receiving funds allocated pursuant to this
31section, the governing board or body of the local educational
32agency shall do both of the following:

33(1) Develop and adopt a plan delineating how funds allocated
34pursuant to this section shall be spent. The plan shall be explained
35in a regularly scheduled public meeting of the governing board or
36body of the local educational agency before its adoption in a
37subsequent regularly scheduled public meeting.

38(2) On or before January 1, 2017, report detailed expenditure
39information to the department, including, but not limited to, specific
40purchases made and the number of teachers, administrators,
P4    1paraprofessional educators, or other classified employees that
2received professional development. The department shall determine
3the format for this report.

4(e) The department shall summarize the information reported
5pursuant to paragraph (2) of subdivision (d) and shall submit the
6summary to the appropriate budget subcommittees and policy
7committees of the Legislature on or before July 3, 2017.

8(f) The requirement for submitting a report imposed under
9subdivision (e) is inoperative on January 1, 2020, pursuant to
10Section 10231.5 of the Government Code.

For purposes of this article, “local educational agency”
12means a school district, county office of education, charter school,
13or state special school.

This article shall not be implemented unless funding
15is provided for the Common Core and Next Generation Science
16Standards Implementation Fund in the annual Budget Act or
17another statute.

SEC. 2.  

Upon appropriation by the Legislature from the General
19Fund to the Superintendent of Public Instruction, the
20Superintendent shall allocate the funds specified below in
21accordance with the following:

22(a) The sum of nine hundred million dollars ($900,000,000)
23shall be allocated to local educational agencies for purposes of
24implementing the Common Core and Next Generation Science
25Standards Implementation Fund Act (Article 8 (commencing with
26Section 60130) of Chapter 1 of Part 33 of Division 4 of Title 2 of
27the Education Code).

28(b) The sum of one billion one hundred million dollars
29($1,100,000,000) shall be allocated to local educational agencies
30for purposes of satisfying any outstanding claims pursuant to
31Section 6 of Article XIII B of the California Constitution for
32reimbursement of state-mandated local program costs for any fiscal
33year. It is the intent of the Legislature that local educational
34agencies use these one-time funds for purposes of implementing
35the Common Core and Next Generation Science Standards
36Implementation Fund Act.
