   An act to add Article 8 (commencing with Section 60130) to Chapter
1 of Part 33 of Division 4 of Title 2 of the Education Code,
relating to school finance.

   AB 631, as amended, Bonilla. School finance: Common Core and Next
Generation Science Standards Implementation Fund Act.
   Existing law requires the Academic Content Standards Commission to
develop, and the State Board of Education to adopt or reject,
academic content standards in language arts and mathematics that are
internationally benchmarked and built toward college and career
readiness by high school graduation, and requires at least 85% of
these standards to be the common core academic content standards
developed by the Common Core State Standards Initiative consortium or
any association or related interstate collaboration, except as
specified.
   This bill would establish the Common Core and Next Generation
Science Standards Implementation Fund Act, to be implemented if funds
are received in the annual Budget Act or another statute, as
specified. The bill would require the Superintendent of Public
Instruction to allocate funds for the 2015-16 fiscal year to local
educational agencies, as defined, on the basis of an equal amount per
pupil based on the prior year's enrollment for specified purposes
relating to the integration of common core academic content
standards, Next Generation Science Standards, and English language
development standards in schools, including, among others, the
professional development of teachers, administrators, and
paraprofessional educators or other classified employees involved in
the direct instruction of pupils that is aligned to specified
academic content standards. The bill would require a local
educational agency that receives funds to meet specified
requirements, including reporting detailed expenditure information to
the State Department of Education, and would require the department
to summarize and submit the information to the appropriate budget
subcommittees and policy committees of the Legislature on or before
July 3, 2017.
   The bill would require the Superintendent, upon appropriation by
the Legislature, to allocate  $900,000,000  
$1,000,000,000  to local educational agencies for purposes of
implementing the  act, and to allocate $1.1 billion to local
educational agencies to satisfy outstanding claims pursuant to
Section 6 of Article XIII B of the California Constitution for
reimbursement of state-mandated local program costs for any fiscal
year. The bill would express the Legislature's intent that the local
educational agencies use the latter one-time funds for the act's
purposes.   act.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Article 8 (commencing with Section 60130) is added to
Chapter 1 of Part 33 of Division 4 of Title 2 of the Education Code,
to read:

      Article 8.  Common Core and Next Generation Science Standards
Implementation Fund Act


   60130.  This article shall be known, and may be cited, as the
Common Core and Next Generation Science Standards Implementation Fund
Act.
   60131.  (a) For purposes of implementing the common core academic
content standards, Next Generation Science Standards, and English
language development standards adopted pursuant to Sections 60605.8,
60605.85, as that section read on June 30, 2014, 60605.10, 60605.11,
and 60811.3, as that section read on June 30, 2013, there is hereby
established the Common Core and Next Generation Science Standards
Implementation Fund. It is the intent of the Legislature that local
educational agencies use funds allocated pursuant to subdivision (b)
to support the integration of common core academic content standards,
Next Generation Science Standards, and English language development
standards in instruction for kindergarten and grades 1 to 12,
inclusive, for purposes of establishing quality instructional
programs for all pupils.
   (b) For the 2015-16 fiscal year, subject to subdivision (d), the
Superintendent shall allocate funds to local educational agencies on
the basis of an equal amount per pupil based on the prior year's
enrollment. The allocated funds shall be available for encumbrance
through the 2016-17 fiscal year.
   (c) A local educational agency shall expend funds allocated
pursuant to this section for any of the following purposes:
   (1) Professional development for teachers, administrators, and
paraprofessional educators or other classified employees involved in
the direct instruction of pupils that is aligned to the academic
content standards adopted as specified in subdivision (a).
   (2) Integration of the common core academic content standards,
Next Generation Science Standards, and English language development
standards through technology-based instruction for purposes of
improving the academic performance of pupils.
   (3) Instructional materials aligned to the common core academic
content standards, Next Generation Science Standards, and English
language development standards adopted pursuant to Sections 60605.8,
60605.85, as that section read on June 30, 2014, 60605.10, 60605.11,
and 60811.3, as that section read on June 30, 2013, including, but
not limited to, supplemental instructional materials as provided in
Sections 60605.86, 60605.87, and 60605.88, as those sections read on
June 30, 2014.
   (d) As a condition of receiving funds allocated pursuant to this
section, the governing board or body of the local educational agency
shall do both of the following:
   (1) Develop and adopt a plan delineating how funds allocated
pursuant to this section shall be spent. The plan shall be explained
in a regularly scheduled public meeting of the governing board or
body of the local educational agency before its adoption in a
subsequent regularly scheduled public meeting.
   (2) On or before January 1, 2017, report detailed expenditure
information to the department, including, but not limited to,
specific purchases made and the number of teachers, administrators,
paraprofessional educators, or other classified employees that
received professional development. The department shall determine the
format for this report.
   (e) The department shall summarize the information reported
pursuant to paragraph (2) of subdivision (d) and shall submit the
summary to the appropriate budget subcommittees and policy committees
of the Legislature on or before July 3, 2017.
   (f) The requirement for submitting a report imposed under
subdivision (e) is inoperative on January 1, 2020, pursuant to
Section 10231.5 of the Government Code.
   60132.  For purposes of this article, "local educational agency"
means a school district, county office of education, charter school,
or state special school.
   60133.  This article shall not be implemented unless funding is
provided for the Common Core and Next Generation Science Standards
Implementation Fund in the annual Budget Act or another statute.
  SEC. 2.  Upon appropriation by the Legislature from the General
Fund to the Superintendent of Public Instruction, the Superintendent
shall allocate the  funds specified below in 
 accordance with the following: 
    (a)     The sum of nine
hundred million dollars ($900,000,000) shall be allocated 
 sum of one billion dollars ($1,000,000,000)  to local
educational agencies for purposes of implementing the Common Core and
Next Generation Science Standards Implementation Fund Act (Article 8
(commencing with Section 60130) of Chapter 1 of Part 33 of Division
4 of Title 2 of the Education Code). 
   (b) The sum of one billion one hundred million dollars
($1,100,000,000) shall be allocated to local educational agencies for
purposes of satisfying any outstanding claims pursuant to Section 6
of Article XIII B of the California Constitution for reimbursement of
state-mandated local program costs for any fiscal year. It is the
intent of the Legislature that local educational agencies use these
one-time funds for purposes of implementing the Common Core and Next
Generation Science Standards Implementation Fund Act.
