Existing law gives the Department of Transportation full possession and control of all state highways. Existing law describes the authorized routes in the state highway system and establishes a process for adoption of a highway on an authorized route by the California Transportation Commission. Existing law also authorizes the commission to relinquish certain state highway segments to local agencies.
This bill would authorize the commission to relinquish to the City of Tehachapi and the County of Kern specified portions of State Highway Route 202, under certain conditions. The bill would provide that these relinquishments shall be made only if the sum of $28,000,000 in state funds is appropriated to the City of Tehachapi and the County of Kern for maintenance of the relinquished segments.

The people of the State of California do enact as follows:
Section 502 of the Streets and Highways Code

3(b) Upon a determination by the commission that it is in the
4best interests of the state to do so, the commission may, upon terms
5and conditions approved by it, relinquish to the City of Tehachapi
6the portion of Route 202 that is located within the city limits of
7that city and relinquish to the County of Kern the portion of Route
8202 located within the unincorporated County of Kern, if the city
9and county agree to accept their respective segments. The following
10conditions shall
apply upon relinquishment of either or both
11segments:
12(1) The relinquishment shall become effective on the date
13following the county recorder’s recordation of the relinquishment
14resolution containing the commission’s approval of the terms and
15conditions of the relinquishment.
16(2) On and after the effective date of the relinquishment, the
17relinquished portion of Route 202 shall cease to be a state highway.
18(3) The portion of Route 202 relinquished under this subdivision
19shall be ineligible for future adoption under Section 81.
20(c) The relinquishments described in subdivision (b) shall be
21made only if the sum of twenty-eight million dollars ($28,000,000)
22in state funds is appropriated to the City of Tehachapi and the
23County of Kern for maintenance of the relinquished segments.
