An act to amend Section 316 of the Streets and Highways Code, relating to state highways.

AB 652, as introduced, Cooley. State Highway Route 16: relinquishment: County of Sacramento.

Existing law gives the Department of Transportation full possession and control of all state highways. Existing law describes the authorized routes in the state highway system and establishes a process for adoption of a highway on an authorized route by the California Transportation Commission. Existing law authorizes the commission to relinquish certain state highway segments to local agencies.

Existing law authorizes the commission to relinquish to the County of Sacramento the portion of State Highway Route 16 that is located within the unincorporated area of the county, east of the City of Sacramento boundary and west of Watt Avenue, under certain conditions.

This bill would extend this authorization to the portion of State Highway Route 16 that is east of the City of Sacramento boundary and west of Grant Line Road. The bill would state the intent of the Legislature in this regard.

The people of the State of California do enact as follows:

SECTION 1.  

It is the intent of the Legislature that the County
2of Sacramento notify and consult with the Amador County
3Transportation Commission, the Counties of Amador, Calaveras,
4and Alpine, the Cities of Plymouth, Amador City, Sutter Creek,
5and Jackson, and other relevant parties about any proposed
6relinquishment of Route 16 to the County of Sacramento as
7provided in this act.

SEC. 2.  

Section 316 of the Streets and Highways Code is
9amended to read:

316.  

(a) Route 16 is from:

11(1) Route 20 to Route 5 near Woodland via Rumsey and
12Woodland.

13(2) Route 50 near Perkins to Route 49 near Drytown.

14(b) Upon a determination by the commission that it is in the
15best interests of the state to do so, the commission may, upon terms
16and conditions approved by it, relinquish to the City of Sacramento
17the portion of Route 16 that is located within the city limits of that
18city if the city agrees to accept it. The following conditions shall
19apply upon relinquishment:

20(1) The relinquishment shall become effective on the date
21following the county recorder’s recordation of the relinquishment
22resolution containing the commission’s approval of the terms and
23conditions of the relinquishment.

24(2) On and after the effective date of the relinquishment, the
25relinquished portion of Route 16 shall cease to be a state highway.

26(3) The portion of Route 16 relinquished under this subdivision
27shall be ineligible for future adoption under Section 81.

28(4) For the portion of Route 16 relinquished under this
29subdivision, the City of Sacramento shall apply for approval of a
30business route designation for the relinquished portion of the
31highway in accordance with Chapter 20, Topic 21, of the Highway
32Design Manual.

33(5) For the portion of Route 16 relinquished under this
34subdivision, the City of Sacramento shall install and maintain
35within its jurisdiction signs directing motorists to the continuation
36of Route 16 to the east.

37(6) The City of Sacramento shall maintain the Surface
38Transportation Assistance Act (STAA) truck route designation for
P3    1the portion of Route 16 relinquished that previously held that
2designation.

3(c) Upon a determination by the commission that it is in the best
4interests of the state to do so, the commission may, upon terms
5and conditions approved by it, relinquish to the County of
6Sacramento the portion of Route 16 that is located within the
7unincorporated area of that county, east of the City of Sacramento
8boundary and west ofbegin delete Watt Avenue,end deletebegin insert Grant Line Road,end insert if the county
9agrees to accept it. The following conditions shall apply upon
10relinquishment:

11(1) The relinquishment shall become effective on the date
12following the county recorder’s recordation of the relinquishment
13resolution containing the commission’s approval of the terms and
14conditions of the relinquishment.

15(2) On and after the effective date of the relinquishment, the
16relinquished portion of Route 16 shall cease to be a state highway.

17(3) The portion of Route 16 relinquished under this subdivision
18shall be ineligible for future adoption under Section 81.

19(4) For the portion of Route 16 relinquished under this
20subdivision, the County of Sacramento shall apply for approval
21of a business route designation for the relinquished portion of the
22highway in accordance with Chapter 20, Topic 21, of the Highway
23Design Manual.

24(5) For the portion of Route 16 relinquished under this
25subdivision, the County of Sacramento shall install and maintain
26within its jurisdiction signs directing motorists to the continuation
27of Route 16 to the east.

28(6) The County of Sacramento shall maintain the STAA truck
29route designation for the portion of Route 16 relinquished that
30previously held that designation.
