An act to amend Section 316 of the Streets and Highways Code, relating to state highways.

Existing law gives the Department of Transportation full possession and control of all state highways. Existing law describes the authorized routes in the state highway system and establishes a process for adoption of a highway on an authorized route by the California Transportation Commission. Existing law authorizes the commission to relinquish certain state highway segments to local agencies.

Existing law authorizes the commission to relinquish to the County of Sacramento the portion of State Highway Route 16 that is located within the unincorporated area of the county, east of the City of Sacramento boundary and west of Watt Avenue, under certain conditions.

This bill would revise this authorization to apply to specified portions of State Highway Route 16 between South Watt Avenue and Grant Line Road, and would impose additional conditions on the relinquishment. The bill would state the intent of the Legislature in this regard.

This bill would also authorize the commission to relinquish to the City of Rancho Cordova a specified portion of State Highway Route 16, under certain conditions.

The people of the State of California do enact as follows:

SECTION 1.  

It is the intent of the Legislature that the County
2of Sacramento notify and consult with the Amador County
3Transportation Commission, the Counties of Amador, Calaveras,
4and Alpine, the Cities of Plymouth, Amador City, Sutter Creek,
5and Jackson, and other relevant parties about any proposed
6relinquishment of Route 16 to the County of Sacramento as
7provided in this act.

SEC. 2.  

Section 316 of the Streets and Highways Code is
9amended to read:

316.  

(a) Route 16 is from:

11(1) Route 20 to Route 5 near Woodland via Rumsey and
12Woodland.

13(2) Route 50 near Perkins to Route 49 near Drytown.

14(b) Upon a determination by the commission that it is in the
15best interests of the state to do so, the commission may, upon terms
16and conditions approved by it, relinquish to the City of Sacramento
17the portion of Route 16 that is located within the city limits of that
18city if the city agrees to accept it. The following conditions shall
19apply upon relinquishment:

20(1) The relinquishment shall become effective on the date
21following the county recorder’s recordation of the relinquishment
22resolution containing the commission’s approval of the terms and
23conditions of the relinquishment.

24(2) On and after the effective date of the relinquishment, the
25relinquished portion of Route 16 shall cease to be a state highway.

26(3) The portion of Route 16 relinquished under this subdivision
27shall be ineligible for future adoption under Section 81.

28(4) For the portion of Route 16 relinquished under this
29subdivision, the City of Sacramento shall apply for approval of a
30business route designation for the relinquished portion of the
31highway in accordance with Chapter 20, Topic 21, of the Highway
32Design Manual.

P3    1(5) For the portion of Route 16 relinquished under this
2subdivision, the City of Sacramento shall install and maintain
3within its jurisdiction signs directing motorists to the continuation
4of Route 16 to the east.

5(6) The City of Sacramento shall maintain the Surface
6Transportation Assistance Act (STAA) truck route designation for
7the portion of Route 16 relinquished that previously held that
8designation.

9(c) (1) Upon a determination by the commission that it is in the
10best interests of the state to do so, the commission may, upon terms
11and conditions approved by it, relinquish to the County of
12Sacramento the following portions of Route 16 if the county agrees
13to accept them:

14(A) The westbound lanes between the City of Sacramento’s city
15limit and west of South Watt Avenue, from post mile 3.28 to post
16mile 4.09.

27(2) The following conditions shall apply upon relinquishment:

28(A) The relinquishment shall become effective on the date
29following the county recorder’s recordation of the relinquishment
30resolution containing the commission’s approval of the terms and
31conditions of the relinquishment.

32(B) On and after the effective date of the relinquishment, the
33relinquished portions of Route 16 shall cease to be a state highway.

34(C) The portions of Route 16 relinquished under this subdivision
35shall be ineligible for future adoption under Section 81.

36(D) For the portions of Route 16 relinquished under this
37subdivision, the County of Sacramento shall apply for approval
38of a business route designation for the relinquished portions of the
39highway in accordance with Chapter 20, Topic 21, of the Highway
40Design Manual.

P4    1(E) For the portions of Route 16 relinquished under this
2subdivision, the County of Sacramento shall install and maintain
3within its jurisdiction signs directing motorists to the continuation
4of Route 16 to the east.

5(F) The County of Sacramento shall maintain the STAA truck
6route designation for the portions of Route 16 relinquished that
7previously held that designation.

8(G) The County of Sacramento shall ensure the continuity of
9traffic flow on the relinquished portions of Route 16 within its
10jurisdiction, including, but not limited to, any traffic signal
11progression.

12(H) Any relinquishment agreement shall require that the County
13of Sacramento administer the operation and maintenance of the
14roadway in a manner that is consistent with professional traffic
15engineering standards.

16(I) Any relinquishment agreement shall require the County of
17Sacramento to ensure that appropriate traffic studies or analyses
18will be performed to substantiate decisions affecting traffic on the
19roadway.

20(d) Upon a determination by the commission that it is in the
21best interests of the state to do so, the commission may, upon terms
22and conditions approved by it, relinquish to the City of Rancho
23Cordova the portion of Route 16 that is the westbound lanes
24between Sunrise Boulevard and Grant Line Road, from post mile
2511.47 to post mile 12.54, if the city agrees to accept it. The
26following conditions shall apply upon relinquishment:

27(1) The relinquishment shall become effective on the date
28following the county recorder’s recordation of the relinquishment
29resolution containing the commission’s approval of the terms and
30conditions of the relinquishment.

31(2) On and after the effective date of the relinquishment, the
32relinquished portion of Route 16 shall cease to be a state highway.

33(3) The portion of Route 16 relinquished under this subdivision
34shall be ineligible for future adoption under Section 81.

35(4) For the portion of Route 16 relinquished under this
36subdivision, the City of Rancho Cordova shall apply for approval
37of a business route designation for the relinquished portion of the
