An act to amend Section 316 of the Streets and Highways Code, relating to state highways.

AB 652, as amended, Cooley. State Highway Route 16: relinquishment.

Existing law gives the Department of Transportation full possession and control of all state highways. Existing law describes the authorized routes in the state highway system and establishes a process for adoption of a highway on an authorized route by the California Transportation Commission. Existing law authorizes the commission to relinquish certain state highway segments to local agencies.

Existing law authorizes the commission to relinquish to the County of Sacramento the portion of State Highway Route 16 that is located within the unincorporated area of the county, east of the City of Sacramento boundary and west of Watt Avenue, under certain conditions.

This bill would revise this authorization to apply tobegin insert aend insert specifiedbegin delete portionsend deletebegin insert portionend insert of State Highway Route 16begin delete between South Watt Avenueend deletebegin insert that is located within the unincorporated area of the county, between the general easterly city limits of the City of Sacramentoend insert andbegin insert nearend insert Grant Line Road, and would impose additional conditions on the relinquishment. The bill would state the intent of the Legislature in this regard.

This bill would also authorize the commission to relinquish to the City of Rancho Cordova a specified portion of State Highway Route 16, under certain conditions.

The people of the State of California do enact as follows:

SECTION 1.  

It is the intent of the Legislature that the County
2of Sacramento notify and consult with the Amador County
3Transportation Commission, the Counties of Amador, Calaveras,
4and Alpine, the Cities of Plymouth, Amador City, Sutter Creek,
5and Jackson, and other relevant parties about any proposed
6relinquishment of Route 16 to the County of Sacramento as
7provided in this act.

SEC. 2.  

Section 316 of the Streets and Highways Code is
9amended to read:

316.  

(a) Route 16 is from:

11(1) Route 20 to Route 5 near Woodland via Rumsey and
12Woodland.

13(2) Route 50 near Perkins to Route 49 near Drytown.

14(b) Upon a determination by the commission that it is in the
15best interests of the state to do so, the commission may, upon terms
16and conditions approved by it, relinquish to the City of Sacramento
17the portion of Route 16 that is located within the city limits of that
18city if the city agrees to accept it. The following conditions shall
19apply upon relinquishment:

20(1) The relinquishment shall become effective on the date
21following the county recorder’s recordation of the relinquishment
22resolution containing the commission’s approval of the terms and
23conditions of the relinquishment.

24(2) On and after the effective date of the relinquishment, the
25relinquished portion of Route 16 shall cease to be a state highway.

26(3) The portion of Route 16 relinquished under this subdivision
27shall be ineligible for future adoption under Section 81.

P3    1(4) For the portion of Route 16 relinquished under this
2subdivision, the City of Sacramento shall apply for approval of a
3business route designation for the relinquished portion of the
4highway in accordance with Chapter 20, Topic 21, of the Highway
5Design Manual.

6(5) For the portion of Route 16 relinquished under this
7subdivision, the City of Sacramento shall install and maintain
8within its jurisdiction signs directing motorists to the continuation
9of Route 16 to the east.

10(6) The City of Sacramento shall maintain the Surface
11Transportation Assistance Act (STAA) truck route designation for
12the portion of Route 16 relinquished that previously held that
13designation.

14(c) (1) Upon a determination by the commission that it is in the
15best interests of the state to do so, the commission may, upon terms
16and conditions approved by it, relinquish to the County of
17Sacramento thebegin delete following portions of Route 16 if the county agrees
18to accept them:end delete

19unincorporated area of the county and between the general easterly
20city limits of the City of Sacramento, approximately post mile 3.3,
21and 0.2 miles east of Grant Line Road, approximately post mile
2212.7, if the county agrees to accept it.end insert

23(A) The westbound lanes between the City of Sacramento’s city
24limit and west of South Watt Avenue, from post mile 3.28 to post
25mile 4.09.

26(B) All lanes between South Watt Avenue and Sunrise
27Boulevard, from post mile 4.09 to post mile 11.47.

28 (C) The eastbound lanes between Sunrise Boulevard and Grant
29Line Road along the city limits of the City of Rancho Cordova,
30from post mile 11.47 to post mile 12.54.

31 (D) All lanes between Grant Line Road and 0.2 miles east of
32Grant Line Road, from post mile 12.54 to post mile 12.74.

33(2) The following conditions shall apply upon relinquishment:

34(A) The relinquishment shall become effective on the date
35following the county recorder’s recordation of the relinquishment
36resolution containing the commission’s approval of the terms and
37conditions of the relinquishment.

38(B) On and after the effective date of the relinquishment, the

381.

4(D) For thebegin delete portionsend deletebegin insert portionend insert of Route 16 relinquished under this
5subdivision, the County of Sacramento shall apply for approval
6of a business route designation for the relinquishedbegin delete portionsend deletebegin insert portionend insert
7 of the highway in accordance with Chapter 20, Topic 21, of the
8Highway Design Manual.

9(E) For thebegin delete portionsend deletebegin insert portionend insert of Route 16 relinquished under this
10subdivision, the County of Sacramento shall install and maintain
11within its jurisdiction signs directing motorists to the continuation
12of Route 16 to the east.

13(F) The County of Sacramento shall maintain the STAA truck
14route designation for thebegin delete portionsend deletebegin insert portionend insert of Route 16 relinquished
15that previously held that designation.

16(G) The County of Sacramento shall ensure the continuity of
17traffic flow on the relinquishedbegin delete portionsend deletebegin insert portionend insert of Route 16 within
18its jurisdiction, including, but not limited to, any traffic signal
19progression.

20(H) Any relinquishment agreement shall require that the County
21of Sacramento administer the operation and maintenance of the
22roadway in a manner that is consistent with professional traffic
23engineering standards.

24(I) Any relinquishment agreement shall require the County of
25Sacramento to ensure that appropriate traffic studies or analyses
26will be performed to substantiate decisions affecting traffic on the
27roadway.

28(d) Upon a determination by the commission that it is in the
29best interests of the state to do so, the commission may, upon terms
30and conditions approved by it, relinquish to the City of Rancho
31Cordova the portion of Route 16 that isbegin delete the westbound lanesend deletebegin insert within
32the city limits of the cityend insert

35 if the city agrees to accept it. The following conditions shall apply
36upon relinquishment:

37(1) The relinquishment shall become effective on the date
38following the county recorder’s recordation of the relinquishment
39resolution containing the commission’s approval of the terms and
40conditions of the relinquishment.

2relinquished portion of Route 16 shall cease to be a state highway.

3(3) The portion of Route 16 relinquished under this subdivision
4shall be ineligible for future adoption under Section 81.

5(4) For the portion of Route 16 relinquished under this
