          Original Committee Reference: HIGHER ED.

SUMMARY: Expands the means by which a California Community
College (CCC) district may secure contract bids to include
posting a notice on its Internet Web site or through an
electronic portal; and, clarifies that existing Education Code
and Public Contract Code provisions do not preclude the
governing board of a community college district from purchasing
materials, equipment, supplies, or services under the same
conditions as those specified in a contract lawfully awarded by
the University of California (UC) or the California State
          University (CSU).

                                                                     AB 653

                                                                    Page 2

1)Expand the means by which a community college district may
secure contract bids by authorizing a community college
district to post the notice for bids on its Internet Web site
            or through an electronic portal.

2)Clarify that the contracting provisions applicable to the CCC
in the Education Code do not preclude the governing board of a
district from purchasing materials, equipment, supplies, or
services under the same conditions as those specified in a
contract lawfully awarded by the UC or the CSU and makes a
parallel change making the same clarification in the Public
            Contract Code.

          EXISTING LAW:

1)Requires, for the purpose of securing bids, a community
college board to publish at least once a week for two weeks in
some newspaper of general circulation published in the
district, or if there is no such paper, then in some newspaper
of general circulation, circulated in the county, a notice
calling for bids or proposals, stating the work to be done or
materials or supplies to be furnished and the time when and
the place where bids or proposals will be opened (Education
            Code Section 81641).
2)Limits the term of continuing contracts for work to be done
with an accepted vendor for services to be performed, or for
apparatus or equipment to be furnished, sold, built,
installed, or repaired for the district, to no more than five
years. Continuing contracts for materials or supplies to be
furnished or sold to the district may not exceed three years
            (Education Code Section 81644).

FISCAL EFFECT: According to the Senate Appropriations
Committee, pursuant to Senate Rule 28.8, negligible state costs.

COMMENTS: Purpose of this bill. According to the author, the
purpose of this bill is to create efficiencies by making it

                                                                     AB 653

                                                                    Page 3

easier for community college districts, the UC and the CSU to
share contracts with each other. The author contends that,
while the UC and CSU have coordinated in sharing contracts
negotiated by one segment with another, existing statutes
governing the community colleges have made it difficult for them
to participate in these shared contracts.
