Existing law establishes various programs to provide financial assistance for energy efficiency upgrades and investments. Under existing law, the State Air Resources Board has issued regulations to reduce emissions from diesel auxiliary engines on container ships, passenger ships, and refrigerated cargo ships while berthing at a California port.
This bill would require the state board, in conjunction with the State Energy Resources Conservation and Development Commission, to develop and implement the Energy Efficient Ports Program to fund energy efficiency upgrades and investments at public ports.

The people of the State of California do enact as follows:
Chapter 4.3 (commencing with Section 39735)

(a) The state board, in conjunction with the State
8Energy Resources Conservation and Development Commission,
9shall develop and implement the Energy Efficient Ports Program
10to fund energy efficiency upgrades and investments at publicbegin delete ports.end delete
11begin insert ports that help reduce the emissions of criteria pollutants, toxic
12air contaminants, and greenhouse gases.end insert
13(b) Projects eligible for funding in the program shall include,
14but are not limited to, the following:
15(1) Installation ofbegin delete solarend deletebegin insert solar, wind, and other renewableend insert
16 technologies at marine terminals, and warehouses and other freight
17facilities at the ports.
18(2) Replacement of conventional lighting with light emitting
19diodes (LED) lighting at the ports.
20(3) Installation of cold ironing or shorepower equipment on
21vessels, beyond actions required by regulations, to facilitate
22reduced emissions from diesel auxiliary engines on container ships,
23passenger ships, and refrigerated cargo ships while berthing at a
24California port.
25(4) Deployment of zero and near-zero emission vehicles and
26
infrastructure technologies, including, but not limited to, stationary
27fuel cells, energy storage and battery, and electric trucks at
28California ports.
29(5) Other projects that reduce grid-based energy demand from
30cargo handling operations at public seaports.
31(c) The state board, in consultation with the State Energy
32Resources Conservation and Development Commission, shall
33develop guidelines through the funding plan process for the Air
34Quality Improvement Program established pursuant to Article 3
35(commencing with Section 44274) of Chapter 8.9 of Part 5 for the
36implementation of this chapter that are consistent with the
37California Global Warming Solutions Act of 2006 (Division 25.5
P3 1(commencing with Section 38500) and Chapter 4.1 (commencing
2with Section 39710)).
