AB 678, as amended, O'Donnell. Greenhouse gases: Energy Efficient Ports Program.
Existing law establishes various programs to provide financial assistance for energy efficiency upgrades and investments. Under existing law, the State Air Resources Board has issued regulations to reduce emissions from diesel auxiliary engines on container ships, passenger ships, and refrigerated cargo ships while berthing at a California port. Existing law establishes the Greenhouse Gas Reduction Fund as a special fund in the State Treasury, and requires that all moneys collected by the state board from the auction or sale of specified greenhouse gas allowances, be deposited in the fund and available for appropriation by the Legislature.
This bill would require the state board, in conjunction with the State Energy Resources Conservation and Development Commission, to develop and implement the Energy Efficient Ports Program to fund energy
efficiency upgrades and investments at public portsbegin insert, as describedend insert. The bill would authorize the state board to expend moneys it receives from an appropriation from the fund for thebegin delete purposes,end deletebegin insert purposesend insert of the bill, as provided.

The people of the State of California do enact as follows:
Chapter 4.3 (commencing with Section 39735)
2is added to Part 2 of Division 26 of the Health and Safety Code,
3to read:

(a) The state board, in conjunction with the State
8Energy Resources Conservation and Development Commission,
9shall develop and implement the Energy Efficient Ports Program
10to fund energy efficiency upgrades and investments at public ports
11that help reduce the emissions of criteria pollutants, toxic air
12contaminants, and greenhouse gases.
13(b) Projects eligible for funding in the program shall include,
14but are not limited to, the following:
15(1) Installation of solar, wind, and other renewable technologies
16at marine terminals, and warehouses and other freight facilities at
17the ports.
18(2) Replacement of conventional lighting with light emitting
19diodes (LED) lighting at the ports.
20(3) Installation of cold ironing or shorepowerbegin delete equipmentend delete
21begin insert equipment, or other emissions control or reduction technologies,end insert
22 on vessels, beyond actions required by regulations, to facilitate
23reduced emissions from diesel auxiliary engines on container ships,
24passenger ships, and refrigerated cargo ships while berthing at a
25California port.
26(4) Deployment of zero and near-zero emission vehicles and
27
infrastructure technologies, including, but not limited to, stationary
28fuel cells, energy storage and battery, and electric trucks at
29California ports.
P3 1(5) Other projects that reduce grid-based energy demand from
2cargo handling operations at public seaports.
3(c) The state board, in consultation with the State Energy
4Resources Conservation and Development Commission, shall
5develop guidelines for the implementation of this chapter that are
6consistent with the California Global Warming Solutions Act of
72006 (Division 25.5 (commencing with Section 38500) and Chapter
84.1 (commencing with Section 39710)).
9(d) Moneys appropriated to the state board from the Greenhouse
10Gas Reduction Fund, established pursuant
to Section 16428.8 of
11the Government Code, for the purposes of paragraph (1) of
12subdivision (c) of Section 39712 may be used for the purposes of
13this section.
