SUMMARY: Prohibits the issuance of a new license if an unpaid
fine remains outstanding; changes references to licensee titles
and pronouns, either changing male-specific terms to gender
neutral or adding female-specific terms; and makes conforming
and technical changes.
The Senate amendments deleted the majority of the bill, leaving
some of the old provisions and adding the language relating to
the issuance of a new license and additional changes relating to
the use of gender-specific pronouns.

1)Establishes the Bureau of Real Estate (BRE) within the
Department of Consumer Affairs (DCA). The BRE administers and
enforces the Real Estate Law, which deals with the licensing
and regulation real estate salespersons, brokers, and mortgage
loan originators. (Business and Professions Code (BPC)
Section 10000 et seq.)
2)Prohibits the renewal of a license if an unpaid fine remains
outstanding or the terms of a citation have not been complied
with. (BPC Section 10080.9)
FISCAL EFFECT: According to the Senate Appropriations
Committee, pursuant to Senate Rule 28.8, negligible state costs.
COMMENTS:
Purpose. This bill is sponsored by The California Association
of Realtors. According to the author, "[this bill] updates the
[BPC] to refer to a salesman as a salesperson, updates
references to 'he' or 'his' to be 'he or she', and [refers] to a
broker as 'the broker' rather than 'he'. A licensee may elect
to refer to his or her licensed status as real estate salesman,
real estate saleswoman, or real estate salesperson."
BRE. Real estate licensing in California began in 1917. The
BRE is the state entity administers and enforces the Real Estate
Law, the Subdivided Lands Act, and the Vacation Ownership and
Timeshare Act of 2004. As a result, the BRE's mission is to
protect consumers by licensing and regulating the licensees
under the above statutes.
