An act to add Chapter 13 (commencing with Section 108950) to Part 3 of Division 104 of the Health and Safety Code, relating to consumer product safety.

Existing law regulates the labeling and use of various consumer products, including toys and toxic household products.

This bill would, commencing January 1, 2017, require the manufacturer of cleaning products for retail sale in this state to disclose each ingredient contained in the product onbegin delete the product label, as specified, post the product ingredient information and certain additional information onend delete the manufacturer’s Internet Webbegin delete site,end deletebegin insert siteend insert and provide the Internet Web site and page address on the product label, along with a prescribed statement.

SECTION 1.  

Chapter 13 (commencing with Section 108950)

For purposes of this chapter, the following definitions
8shall apply:

9(a) “Chemically formulated consumer product” means a
10consumer product, as defined in subdivision (e) of Section 25251,
11but excluding home appliances, that is manufactured from
12chemicals or chemical compounds to be used by household,
13institutional, commercial, and industrial consumers without further
14processing for specific purposes. For the purposes of this
15subdivision, dilution by the consumer is not considered further
16processing.

17(b) “Cleaning product” means any product included in the
18following categories:

19(1) “Air care product” means a chemically formulated consumer
20product designed, or labeled to indicate that the purpose of the
21product is, to mask odors or to freshen, clean, scent, or deodorize
22the air.

23(2) “Automotive product” means a chemically formulated
24consumer product designed, or labeled to indicate that the purpose
25of the product is, to maintain the appearance of a motor vehicle,
26as defined in Section 670 of the Vehicle Code, including products
27for washing, waxing, polishing, cleaning, or treating the exterior
28or interior surfaces of motor vehicles. “Automotive product” does
29not include automotive paint or paint repair products.

30(3) “General cleaning product” means a soap, detergent, or other
31chemically formulated consumer product designed, or labeled to
32indicate that the purpose of the product is, to clean or disinfect
33surfaces, including, but not limited to, floors, furniture, countertops,
P3    1showers and baths, or other hard surfaces, such as stovetops,
2microwaves, and other appliances, fabric care, or dish or other
3ware washing.

4(4) “Polish or floor maintenance product” means a chemically
5formulated consumer product, such as polish, wax, or a restorer,
6designed, or labeled to indicate that the purpose of the product is,
7to polish, protect, buff, condition, temporarily seal, or maintain
8furniture, floors, metal, leather, or other surfaces.

9(c)  “Incidental ingredient” means a contaminant in or on
10feedstock, water, or processing equipment, or byproducts or
11intermediates unintentionally introduced during formulation, that
12are present at a level of 25 parts per million or more and have no
13technical or functional effect in the finished cleaning product.

21assembles, produces, packages, repackages, or relabels a cleaning
22product that is sold or used in this state.

(a) (1) For purposes of disclosing each ingredient

3chemicals posted on the Internet Web site of the department
4pursuant to Section 69502.3 of Title 22 of the California Code of
5Regulations, that ingredient shall be listed on the label in
6descending order of predominance.

17Products Association (CSPA) Consumer Product Ingredients
18Dictionary name. If a CSPA Consumer Product Ingredients
19Dictionary name is not available, an ingredient shall be listed by
20its International Nomenclature Cosmetic Ingredient (INCI) name.
21If an INCI name is also not available, an ingredient shall be listed
22by its International Union of Pure and Applied Chemistry (IUPAC)
23name. If an IUPAC name is also not available, an ingredient shall
24be listed by its common chemical name and the Chemical Abstract
25Service (CAS) number.

26(2) The CAS number of an ingredient need only be included on
27the ingredient list provided on the manufacturer’s Internet Web
28site.

29(c) If the product contains a chemical listed on the informational
30list of candidate chemicals posted on the Internet Web site of the
31department pursuant to Section 69502.3 of Title 22 of the
32California Code of Regulations, the manufacturer shall post on its
33Internet Web site a statement that additional information about
34any potential health impacts of the ingredients may be obtained
35from the Internet Web sites for the following and shall post a link
36to the Internet Web sites:

37(1) The informational list of candidate chemicals posted on the
38Internet Web site of the department pursuant to Section 69502.3
39of Title 22 of the California Code of Regulations.

2of Medicine.

3(d) The manufacturer shall update its product labels, if
4necessary, no later than one year after a new chemical is added to
5the list of candidate chemicals posted on the Internet Web site of
6the department pursuant to Section 69502.3 of Title 22 of the
7California Code of Regulations.
