An act to amend Section 266h of the Penal Code, relating to crimes.

AB 733, as introduced, Chávez. Crimes: human trafficking.

Existing law provides that a person who, knowing another person is a prostitute, lives or derives support or maintenance from the proceeds of that person’s prostitution or from money loaned or advanced to or charged against the prostitute by a specified person, or who solicits or receives compensation for soliciting for the prostitute, is guilty of the felony of pimping, punishable by imprisonment in the state prison, as specified.

This bill would make technical, nonsubstantive changes to those provisions.

Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no.

The people of the State of California do enact as follows:

SECTION 1.  

Section 266h of the Penal Code is amended to

(a) Except as provided in subdivision (b),begin delete anyend deletebegin insert aend insert person
4who, knowing another person is a prostitute, lives or derives
5support or maintenance in whole or in part from the earnings or
6proceeds of the person’s prostitution, or from money loaned or
7advanced to or charged againstbegin delete that personend deletebegin insert the prostituteend insert by any
P2    1keeper or manager or inmate of a house or other place where
2prostitution is practiced or allowed, or who solicits or receives
3compensation for soliciting for thebegin delete personend deletebegin insert prostituteend insert, is guilty of
4pimping, a felony, and shall be punishable by imprisonment in the
5state prison for three, four, or six years.

6(b) Any person who, knowing another person is a prostitute,
7lives or derives support or maintenance in whole or in part from
8the earnings or proceeds of the person’s prostitution, or from
9money loaned or advanced to or charged againstbegin delete that personend deletebegin insert the
10prostituteend insert
by any keeper or manager or inmate of a house or other
11place where prostitution is practiced or allowed, or who solicits
12or receives compensation for soliciting forbegin delete the personend deletebegin insert the prostituteend insert,
13when the prostitute is a minor, is guilty of pimping a minor, a
14felony, and shall be punishable as follows:

15(1) If thebegin delete person engaged in prostitutionend deletebegin insert prostituteend insert is a minor
1616 years of age or older, the offense is punishable by imprisonment
17in the state prison for three, four, or six years.

18(2) If thebegin delete person engaged in prostitutionend deletebegin insert prostituteend insert is under 16
19years of age, the offense is punishable by imprisonment in the state
20prison for three, six, or eight years.
