   An act to add Section 10299.2 to the Public Contract Code,
relating to public contracts.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 760, as introduced, O'Donnell. Department of General Services:
local educational agencies: portable electronic equipment.
   Existing law authorizes the Director of General Services to
consolidate the needs of multiple state agencies and establish
contracts, master agreements, multiple award schedules, and other
types of agreements that leverage the state's buying power, as
specified. Existing law authorizes the director to make the services
of the Department of General Services available to school districts,
and authorizes school districts to use agreements established by the
department for the acquisition of information technology, goods, and
services.
   This bill would require the department to seek bids for the
purchase of portable electronic equipment and establish a process for
local educational agencies to purchase the equipment under terms
negotiated by the department.
   Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 10299.2 is added to the Public Contract Code,
to read:
   10299.2.  (a) It is the intent of the Legislature to establish a
statewide purchasing pool for the purchase of laptops and other
portable electronic equipment.
   (b) The department shall seek bids for the purchase of portable
electronic equipment and establish a process whereby local
educational agencies may purchase the equipment under terms
negotiated by the department.
   (c) Notwithstanding Sections 20111 and 20112, local educational
agencies may authorize the purchase of any portable electronic
equipment by contract, lease, requisition, or purchase order on the
terms specified in the contract negotiated by the department.
   (d) For purposes of this section, "portable electronic equipment"
includes, but is not limited to, laptops and other handheld devices
that are used for educational purposes.
