An act to amend Section 37104 37105
of the Government Code, relating to local government.

Existing law authorizes the legislative body of a city to issue
subpoenas requiring the attendance of witnesses or production of
books or other documents for evidence or testimony in any action or
proceeding pending before the legislative body. Existing law
requires these subpoenas to be signed by the mayor and attested by
the city clerk.
This bill would make a nonsubstantive change to this provision.
This bill would authorize a city attorney to attest to a subpoena
signed by a mayor.
Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Section 37105 of the
Government Code is amended to read:
37105. Subpenas Subpoenas shall be
signed by the mayor and attested by the city clerk or the city
attorney . They may be served as subpenas
subpoenas are served in civil actions.
SECTION 1. Section 37104 of the Government Code
is amended to read:
37104. The legislative body may issue subpoenas requiring
attendance of witnesses or production of books or other documents for
evidence or testimony in any action or proceeding pending before it.
