Existing law requires state and local agencies to report various information to the Controller and requires the Controller to publish on the Controller’s Internet Web site certain reports, including, but not limited to, the state’s annual financial reports and reports of the financial transactions and information on annual compensation of local agencies.

This bill would require the Controller to include on the Controller’s Internet Web site a feature that enables a user of the Internet Web site to organize, view, and download information in the Controller’s database in specified forms. The bill would also require the Controller to publish reports of the financial transactions and information on annual compensation of local agencies on the Controller’s Internet Web site in a searchable format.

The Public Employees’ Retirement Law (PERL) prescribes the rights and benefits of members of the Public Employees’ Retirement System (PERS), the management and control of which is vested in its board of administration. The California Public Records Act generally requires state and local agencies to make public records available for inspection by the public, subject to specified criteria.

This bill would state the intent of the Legislature to enact legislation that improves the methods by which the Public Employees’ Retirement System delivers information to the public, that more fully reflects the information practices of the system, and that provides for delivery of information that better satisfies the public’s need to understand its operations.

(a) The Controller shall compile, publish, and make
4publicly available on the Controller’s Internet Web site, in a format
5that may bebegin delete printedend deletebegin insert searched, printed,end insert and downloaded, reports
6of the financial transactions and information on annual
7compensation, consistent with subdivision (l) of Section 53892,
8of each county, city, and special district, respectively, within this
9state, together with any other matter he or she deems of public
10interest. The reports shall include the appropriations limits and the
11total annual appropriations subject to limitation of the counties,
12cities, and special districts. The reports to the Controller shall be
13 made in the time, form, and manner prescribed by the Controller.

14(b) Effective January 1, 2005, the Controller shall compile and
15publish reports of the financial transactions of each county, city,
16and special district pursuant to subdivision (a) on or before August
171, September 1, and October 1 respectively, of each year following
18the end of the annual reporting period. The Controller shall make
19data collected pursuant to this subdivision available upon request
20to the Legislature and its agents, on or before April 1 of each year.

21(c) The Controller shall annually publish, on the Internet Web
22site of the Controller, reports of the financial transactions of each
23school district within this state, together with any other matter he
24or she deems of public interest. The reports shall include the
25appropriations limit and the total annual appropriations subject to
26limitation of the school district. The reports to the Controller shall
27be made in the time, form, and manner prescribed by the Controller.

P3    1(d) As used in this section, the following terms have the
2following meanings:

3(1) “School district” means a school district as defined in Section
480 of the Education Code.

5(2) “Special district” means any of the following:

6(A) A special district as defined in Section 95 of the Revenue
7and Taxation Code.

8(B) A commission provided for by a joint powers agreement
9pursuant to Chapter 5 (commencing with Section 6500) of Division
107 of Title 1.

11(C) A nonprofit corporation that is any of the following:

12(i) Was formed in accordance with the provisions of a joint
13powers agreement to carry out functions specified in the agreement.

14(ii) Issued bonds, the interest on which is exempt from federal
15income taxes, for the purpose of purchasing land as a site for, or
16purchasing or constructing, a building, stadium, or other facility,
17that is subject to a lease or agreement with a local public entity.

18(iii) Is wholly owned by a public agency.

(a) The Controller shall include on the Controller’s
22Internet Web site a feature that enables a user of the Internet Web
23site to organize, view, and download information in the
24Controller’s database in all of the following forms:

25(1) A summary of entity totals, averages, and breakdowns, that
26can be filtered by entity, year, and entity employees, employee
27compensation, and population.

28(2) A chart, table, or other illustration of the relationship
29between an entity’s employees, employee compensation, and
30population.

31(3) A chart, table, or other illustration of data trends that shows
32the changes over time in an entity’s employees, employee
33compensation, or population.

34(4) A map that illustrates the geographical differences in
35employees, employee compensation, or population of entities across
36the state.

37(5) (A) A list of the entity positions with the highest
38compensation.

39(B) A list of the entities with the highest number of employees,
40employee compensation, or population.

P4    1(6) A side-by-side comparison of the employees, employee
2compensation, residents, and highest-paid positions of two or more
3entities.

4(7) Any additional forms the Controller deems necessary.

5(b) For the purposes of this section, “entity” means a state or
6local agency that reports information to the Controller.

SECTION 1.  

It is the intent of the Legislature to enact
8legislation that improves the methods by which the Public
9Employees’ Retirement System delivers information to the public,
10that more fully reflects the information practices of the system,
11and that provides for delivery of information that better satisfies
