(2) Existing law requires, not later than July 1, 2016, the Department of the California Highway Patrol to implement a program to conduct safety inspections of modified limousine terminals that are operated by passenger stage corporations pursuant to the Public Utilities Act or by charter-party carriers of passengers pursuant to the Passenger Charter-party Carriers’ Act.

SECTION 1.  

Section 27375 of the Vehicle Code is amended

27375.  

(a) Any person who operates a modified limousine
4shall ensure that the vehicle has at least two rear sidebegin delete doorsend deletebegin insert doors,

and one or two rear windows, as
6specified in paragraph (1), that the rear seat passengers or all
7passengers of the vehicle may open from the inside of the vehicle
8in case of any fire or other emergency that may require the
9immediate exit of the passengers of the vehicle. A limousine
10subject to this subdivision shall be equipped with both of the
11following:

12(1) (A) Except as provided in subparagraph (B), at least two
13rear push-out windows that are accessible to all passengers. At
14least one push-out window shall be located on each side of the
15vehicle, unless the design of the limousine precludes the installation
16of a push-out window on one side of the vehicle, in which case
17the second push-out window shall instead be located in the roof
18of the vehicle.

19(B) If the design of the limousine precludes the installation of
20even one push-out window on a side of the vehicle, one push-out
21window shall instead be located in the roof of the vehicle.

22(C) The Department of the California Highway Patrol shall
23establish, by regulation, standards to ensure that window exits are
24operable and sufficient in emergency situations for limousine
25passengers. The department shall ensure that these regulations
26comply with any applicable federal motor vehicle safety standards.

27(D) For modified limousines modified prior to July 1, 2015, the

11(b) In the case of a fire or other emergency that requires the
12immediate exit of the passengers from the limousine, the driver of
13the limousine shall unlock the doors so that the rear side doors can
14be opened by the passengers from the inside of the vehicle.

15(c) An owner or operator of a limousine shall do all of the
16following:

17(1) Instruct all passengers on the safety features of the vehicle
18prior to the beginning of any trip, including, but not limited to,
19instructions for lowering the partition between the driver and
20passenger compartments and for communicating with the driver
21by the use of an intercom or other onboard or wireless device.

22(2) Disclose to the contracting party and the passengers whether
23the limousine meets the safety requirements described in this
24section.

25(3) If paragraphbegin delete (3)end deletebegin insert (1)end insert of subdivision (d) applies, the owner or
26operator of a limousine shall further disclose to the contracting
27party and the passengers that the limousine does not meet the safety
28requirements required in subdivision (a) regarding vehicle escape
29options because of its exempt status, and therefore may pose a
30greater risk to passengers should emergency escape be necessary.

31(d) (1) Subdivision (a) shall apply to all modified limousines
32modified on or after July 1, 2015.

33(2) Paragraph (1) of subdivision (a) shall, beginning January 1,
342017, apply to all vehicles that met the definition of modified
35limousine, as described in subdivision (b) of Section 378, that were
36modified prior to July 1, 2015.

9of the California Highway Patrol shall implement a program to
10conduct safety inspections of modified limousine terminals that
11are operated by passenger stage corporations pursuant to Article
122 (commencing with Section 1031) of Chapter 5 of Part 1 of
13Division 1 of the Public Utilities Code or by charter-party carriers
14of passengers pursuant to the Passenger Charter-party Carriers’
15Act (Chapter 8 (commencing with Section 5351) of Division 2 of
16the Public Utilities Code).

17(b) (1) The inspection program shall include, but is not limited
18to, the safe operation of the vehicle, the installation of safety
19equipment, the retention of maintenance logs, accident reports,
20and records of driver discipline, compliance with federal and state
21motor vehicle safety standards, the examination of a preventative
22maintenance program, and, if ownership of the modified limousine
23has been transferred, the transmission of relevant safety and
24maintenance information of the limousine.

25(2) Pursuant to the safety inspection program, the department
26shall conduct an inspection of each terminal of a charter-party
27carrier of passengers and passenger stage corporation that operates
28modified limousines at least once every 13 months.

29(3) The department shall adopt emergency regulations for
30purposes of this subdivision. The adoption by the department of
31regulations implementing this section shall be deemed to be an
32emergency and necessary to avoid serious harm to the public peace,
33health, safety, or general welfare for purposes of Sections 11346.1
34and 11349.6 of the Government Code, and the department is hereby
35exempted from the requirement that it describe facts showing the
36need for immediate action to the Office of Administrative Law.
37The emergency regulations shall remain in effect for no more than
38one year, by which time final regulations shall be adopted.

39(4) (A) The department shall adopt regulations to establish an
40inspection fee to be collected every 13 months, based on the
P5    1number of modified limousines operated by a single charter-party
2carrier or passenger stage corporation. The fee shall be in an
3amount sufficient to offset the costs to administer the inspection
4program and shall not be used to supplant or support any other
5inspection program conducted by the department. The fee shall be
6in addition to any other required fee. When developing the
7regulations, the department shall consider measures that increase
8efficiencies to limit the financial impact to charter-party carriers
9of passengers and passenger stage corporations subject to the fee.
10The department shall promulgate the regulations in consultation
11with appropriate interested parties.

12(B) The fee structure established pursuant to this subdivision
13shall apply to modified limousines that are required to undergo a
14safety inspection pursuant to this section.

15(C) The fee established pursuant to this subdivision shall be
16collected by the Public Utilities Commission and deposited into
17the Motor Vehicle Account in the State Transportation Fund to
18cover the costs of the inspections conducted by the department.

19(5) The department shall transmit to the Public Utilities
20 Commission inspection data of modified limousine terminals
21inspected pursuant to this program, as specified in the program
22regulations.

23(c) Regulations adopted pursuant to this section shall be
24consistent with the established inspection program administered
25by the department for buses pursuant to this division.
