The Dental Practice Act provides for the licensure and regulation of persons engaged in the practice of dentistry by the Dental Board of Californiabegin delete. The act defines dentistry as the diagnosis or treatment, by surgery or other method, of diseases and lesions and the correction of malpositions of the human teeth, alveolar process, gums, jaws, or associated structures, and provides that a person practices dentistry if that person performs various specified acts.end deletebegin insert, and prohibits the practice of dentistry by any person without a valid license, except in certain circumstances.end insert

(a) (1) In addition to the exemptions set forth in
4Section 1626, the practice of dentistry by a final year student
5rendered or performed without compensation or expectation of
6compensation under the supervision of a licensed dentist in a free
7clinic is exempt from the operation of this chapter.

8(2) The practice of dentistry exempted by paragraph (1) only
9includes those operations, approved by the board, that are
10described in the exemption provided in subdivision (b) of Section
111626 and rendered or performed under the same supervisory
12conditions.

13(b) For purposes of this section, all of the following shall apply:

14(1) “Free clinic” means a clinic as defined in Section 1200 of
15the Health and Safety Code where there are no charges directly
16to the patient for services rendered or for drugs, medicines,
17appliances, or apparatuses furnished, including, but not limited
18to, a free clinic as defined in subparagraph (B) of paragraph (1)
19of subdivision (a) of Section 1204 of the Health and Safety Code.

20(2) “Final year student” means a student of dentistry in his or
21her final year of completion at a dental school approved by the
22board.

23(3) “Licensed dentist” means a dentist licensed pursuant to this
24chapter.

SECTION 1.  

Section 1625 of the Business and Professions
26Code
is amended to read:

1625.  

Dentistry is the diagnosis or treatment, by surgery or
28other method, of diseases and lesions and the correction of
29malpositions of the human teeth, alveolar process, gums, jaws, or
30associated structures. That diagnosis or treatment may include all
31necessary related procedures as well as the use of drugs, anesthetic
32agents, and physical evaluation. Without limiting the foregoing,
33a person practices dentistry within the meaning of this chapter who
34does one or more of the following:

35(a) By card, circular, pamphlet, newspaper, or in any other way
36advertises himself or herself or represents himself or herself to be
37a dentist.

P3    1(b) Performs, or offers to perform, an operation or diagnosis of
2any kind, or treats diseases or lesions of the human teeth, alveolar
3process, gums, jaws, or associated structures, or corrects malposed
4positions thereof.

5(c) In any way indicates that he or she will perform by himself
6or herself or his or her agents or servants an operation upon the
7human teeth, alveolar process, gums, jaws, or associated structures,
8or in any way indicates that he or she will construct, alter, repair,
9or sell a bridge, crown, denture or other prosthetic appliance or
10orthodontic appliance.

11(d) Makes, or offers to make, an examination of, with the intent
12to perform or cause to be performed an operation on the human
13teeth, alveolar process, gums, jaws, or associated structures.

14(e) Manages or conducts as manager, proprietor, conductor,
15lessor, or otherwise, a place where dental operations are performed.
