Under existing law, the council is required to provide advice and investigations for, and perform duties delegated to it by, the secretary, including programs to promote education, research, and public information regarding the consumption of salmon and salmon products. Existing law provides for referendum voting by fishermen, as defined, to determine whether the act should be implemented and, periodically, to review whether the operation of the act and the council should be continued. Upon approval of the referendum, existing law requires fishermen to pay specified assessments to the secretary and requires the secretary to expend and invest those moneys for purposes of the act. A violation of the act is a misdemeanor.

Commission, and instrumentalities that areend insert
engaged in work or

34recommend to the secretary the making of contracts and agreements
35with those organizations or agencies for carrying on joint programs
36of education, research, publicity, and advertising.

5with facilities for the research that is contemplated.

7and promotion of scientific research to develop or discover, or
8both, the health, food, therapeutic, dietetic, and other uses of
9salmon.

11to Article 8 (commencing with Section 76900).
12(2) begin deleteTo allocate end deletebegin insertAllocate end insertfunds to agencies not specifically or

14if the council and the secretary are satisfied that those allocations
15will be beneficial to the California salmon fishery and will tend
16to effectuate the declared purposes of this chapter.

accurate and scientific
27information which shows the importance of the use and
28consumption of salmon and salmon products in relation to the
29public health, economy, and diet, and proper nutrition of children
30and adults.
31(c) Study means and methods which are employed in harvesting,
32processing, manufacturing, marketing, and distributing salmon
33and salmon products in order to comply with the sanitary and other
34regulations which are imposed by municipalities, this state, and
35the United States.
36(d) Gather and disseminate information regarding the high
37standards which are observed and imposed to insure pure and
38wholesome salmon and salmon products.
39(e) Gather and disseminate information regarding the harmful
40effects on the public health resulting from the breakdown or
P11 1instability of the salmon fishery, the factors and
conditions peculiar
2to the salmon fishery which tend to cause an unbalanced
3production, and the price of salmon and salmon products in relation
4to the cost of other items of food in a balanced diet.
5(f) Gather and disseminate information regarding the factors
6which tend to promote increased consumption of salmon and
7salmon products, stabilize the fishery, and foster a better
8understanding and more efficient cooperation among fishermen,
9receivers, processors, and the consuming public.

If the Attorney General determines under Section 76850
13that selling allocation rights to harvest salmon would be binding
14and consistent with California public policy and if an agreement

17in consultation with thebegin delete directorend deletebegin insert secretaryend insert, develop a program to
18authorize the transfer of the allocation rights

21at a price and quantity agreed to by the council, and with funds
22available from the council, enter into an agreement for the purchase

24fide rights to harvest stocks of salmon.

32government’s responsibility to the Indian people and their

5other person the fee shall be remitted to thebegin delete directorend deletebegin insert secretaryend insert by
6the fisherman.
7(b) Every handler subject to this chapter pursuant to Article 9.5
8(commencing with Section 76961) shall pay the fee specified in
9this article for each pound or fraction thereof, of salmon received
10from a fisherman. The fee shall be remitted to the secretary by the
11handler.

30preserved for a period of three years, and shall be available for

18operators submit the names and mailing addresses of all
19commercial salmon vessel operators who harvested salmon during
20the previous season, as evidenced by receipts prepared under
21Section 8043 of the Fish and Game Code, together with the volume
22of salmon landed. The secretary may also request the assistance
23of the Director of Fish and Wildlife for the names of all commercial
24salmon vessel operators who landed salmon the previous season
25and the volume of landings for each vessel. The request for the
26information shall be in writing and shall be subject to the
27confidentiality
provisions of Section 8022 of the Fish and Game
28Code. The list shall be filed within 30 days following receipt of
29the written notice.
Any commercial salmon vessel operator whose name
31does not appear upon the secretary’s list of commercial salmon
32vessel operators affected may have his or her name established
33on the list by filing with the secretary a signed statement,
34identifying himself or herself as a commercial salmon vessel
35operator and furnishing evidence of having made landings the
36previous year through the submission of receipts prepared under
37Section 8043 of the Fish and Game Code. Failure to be on the list
38does not exempt a commercial salmon vessel operator from paying
39assessments under this chapter.
This chapter, except as necessary to conduct an
2implementation referendum vote under this article shall not become
3operative until the secretary finds in an implementation referendum
4conducted by the secretary under this article, that at least 40
5percent of the total number of commercial salmon vessel operators
6from the list established by the secretary have participated by
7voting in the referendum, and the secretary finds either of the
8following:
9(a) Sixty-five percent or more of the commercial salmon vessel
10operators who voted in the referendum voted in favor of
11implementing this chapter, and the commercial salmon vessel
12operators who voted in the referendum marketed 51 percent or
13more of the total quantity of salmon landed in the preceding fiscal
14year by all
the commercial salmon vessel operators who voted in
15the referendum.
16(b) Fifty-one percent of the commercial salmon vessel operators
17who voted in the referendum voted in favor of implementing this
18chapter, and the commercial salmon vessel operators who voted
19in the referendum marketed 65 percent or more of the total quantity
20of salmon landed in the preceding fiscal year by all of the
21commercial salmon vessel operators who voted in the referendum.
The secretary shall establish a period in which to
23conduct the implementation referendum which shall not be more
24than 60 days in duration, and may prescribe additional procedures
25as may be necessary to conduct the referendum. If the initial period
26established is less than 30 days, the secretary may extend that
27period. However, the total referendum period may not exceed 60
28days.
(a) Before the referendum vote is conducted by the
30secretary, the proponents of the council shall deposit with the
31secretary the amount that the secretary determines is necessary
32to defray the expenses of preparing the necessary lists and
33information and conducting the referendum vote.
34(b) Any funds not used in carrying out this article shall be
35returned to the proponents of the council who deposited the funds
36with the secretary.
37(c) Upon establishment of the council, the council may reimburse
38the proponents of the council for any funds deposited with the
39secretary that were used in carrying out this article, and for any
40legal expenses and costs incurred in establishing the
council.
P18 1(d) After approval by the Commercial Salmon Trollers Advisory
2Committee created pursuant to Section 7862 of the Fish and Game
3Code, the Department of Fish and Wildlife may expend funds
4collected pursuant to Section 7861 of the Fish and Game Code,
5for payment to the Secretary of Food and Agriculture to pay
6necessary costs incurred in conducting the implementation
7referendum vote. If the commercial salmon vessel operators who
8voted in the implementation referendum voted in favor of
9implementing this article, as provided in Section 76952, the council
10shall reimburse the Commercial Salmon Stamp Account in the
11Fish and Game Preservation Fund all amounts received from that
12fund.
Nonreceipt of a ballot shall not invalidate a referendum.
(a) If the secretary finds that a favorable vote has been
15given, the secretary shall so certify and give notice of the favorable
16vote to all commercial salmon vessel operators whose names and
17addresses may be on file with the secretary.
18(b) If the secretary finds that a favorable vote has not been
19given, the secretary shall so certify and declare all provisions of
20this chapter inoperative.

8following:
9(a) Sixty-five percent or more of the handlers who voted in the
10referendum voted in favor of being subject to this chapter, and the
11handlers who voted in the referendum handled 51 percent or more
12of the total quantity of salmon landed in the preceding fiscal year
13by all the handlers who voted in the referendum.
14(b) Fifty-one percent of the handlers who voted in the
15referendum
voted in favor of being subject to this chapter, and the
16handlers who voted in the referendum marketed 65 percent or
17more of the total quantity of salmon landed in the preceding fiscal
18year by all of the handlers who voted in the referendum.
The secretary shall establish a period in which to
20conduct the referendum that shall not be more than 60 days in
21duration, and may prescribe additional procedures as may be
22necessary to conduct the referendum. If the initial period
23established is less than 30 days, the secretary may extend that
24period. However, the total referendum period may not exceed 60
25days.

(a) Between January 1, 2019, and February 28, 2019,
13and in the same period each five years thereafter, the secretary
14shall, by the public hearing procedure, and if appropriate, the
15procedure specified in this article, determine whether the council
16program provided for in this chapter shall continue in effect.
17(b) If the secretary finds from evidence received at the hearing
18that a substantial question exists as to whether the council program
19is contrary to or does not effectuate the declared purposes or
20provisions of this chapter or receives in writing a referendum
21petition with the signatures of 25 percent or more of the number
22of commercial salmon vessel operators who made landings in the
23previous year, as evidenced by receipts prepared
under Section
248043 of the Fish and Game Code, and, if applicable, 25 percent
25or more of the handlers who are subject to this chapter, the council
26program shall be submitted to referendum as provided in this
27article.
If the secretary determines that a referendum procedure
29is appropriate, the secretary shall establish a referendum period
30of not to exceed 30 days during which period ballots shall be
31submitted to every commercial salmon vessel operator and, if
32applicable, every handler subject to this chapter on a statewide
33basis. If the secretary determines that the referendum period does
34not provide sufficient time for the balloting, the secretary may
35extend the referendum for an additional period not to exceed 30
36days. The ballots shall provide a “yes” or “no” voting alternative
37to the following question: “Shall the California Salmon Council
38be continued for the next five fiscal years commencing April 1,
39following this referendum?”
If the council program is submitted to a referendum as
2provided in this article, the secretary shall find that commercial
3salmon vessel operators and, if applicable, handlers subject to
4this chapter statewide have approved the council program if the
5secretary finds either of the following:
6(a) Sixty-five percent or more of the total number of commercial
7salmon vessel operators and handlers, who voted in the referendum
8and who harvested 51 percent or more of the total amount of
9salmon landed during the previous fiscal year by all commercial
10salmon vessel operators and handlers who voted in the referendum,
11approve the program.
12(b) Fifty-one percent or more of the total number of commercial
13salmon
vessel operators and handlers, who voted in the review
14referendum and who harvested 65 percent or more of the total
15amount of salmon landed during the previous fiscal year by all
16commercial salmon vessel operators and handlers who voted in
17the review referendum, approve the program.
(a) This chapter shall continue if commercial salmon
19vessel operators and handlers vote for continuation in accordance
20with the requirements of this article.
21(b) This chapter shall not continue in operation if commercial
22salmon vessel operators and handlers vote not to continue in
23accordance with the requirements of this article.
24(c) If commercial salmon vessel operators vote for continuation
25and handlers do not vote for continuation, or if handlers vote for
26continuation and commercial salmon vessel operators do not vote
27for continuation, this chapter shall continue to be operative for
28the group voting for continuation and shall no longer apply to the
29group voting against
continuation.

If the commercial salmon vessel operators and the
37handlers vote to terminate the council pursuant to Article 10
38(commencing with Section 76971), the council shall remain in
39existence for the purpose of furnishing the secretary with a
40complete record of its outstanding financial obligations, accrued
P22 1and to accrue. The secretary shall pay from the money deposited
2and disbursed any outstanding obligations and any obligations
3incurred by the secretary and the department under the terms and
4provisions of this section. Any money that remains shall be retained
5by the secretary to defray the expenses of formulation, issuance,
6administration, or enforcement of any subsequent program for
7salmon promotion. If no such program is undertaken within a
8period of three years from the date of termination of the council,
9that money shall be
withdrawn from the approved depository and
10paid into the special account for enhancement and restoration
11programs established pursuant to Section 7861 of the Fish and
12Game Code.
No reimbursement is required by this act pursuant
14to Section 6 of Article XIII B of the California Constitution because
15the only costs that may be incurred by a local agency or school
16district will be incurred because this act creates a new crime or
17infraction, eliminates a crime or infraction, or changes the penalty
18for a crime or infraction, within the meaning of Section 17556 of
19the Government Code, or changes the definition of a crime within
20the meaning of Section 6 of Article XIII B of the California
21Constitution.
Section 410 of the Food and Agricultural Code
23 is amended to read:
It is the intent of the Legislature that the Department of
25Food and Agriculture, in cooperation with appropriate county
26officials and industry representatives, develop mutually satisfactory
27sources of nonstate funding to augment budget programs in the
28areas of county agricultural commissioners and county sealers of
29weights and measures.
