(1) Existing law establishes the California Avocado Commission, which is charged with, among other duties, promoting the sale of avocados by advertising and other promotional means for the purpose of maintaining and expanding present markets and creating new and larger intrastate, interstate, and foreign markets for avocados. Existing law requires the commission to establish 5 districts within the state, each representing approximately 20% of the avocado production in California, and, beginning in the 2000-01 marketing season, requires those districts to be reapportioned every 5th year in accordance with certain procedures. Under existing law, the commission consists of 10 avocado producers who are not handlers, 2 elected from each of the 5 districts, 4 avocado handlers who are elected on a statewide basis, one public member who is appointed by the Secretary of Food and Agriculture, and the secretary who serves as a nonvoting ex officio member. Existing law also provides for an alternate member for each member of the commission, except the secretary, to be elected in the same manner as the member.

This bill would instead require the commission to establish no fewer than 3 districts and no more than 5 districts within the state, each representing approximately the same percentage of avocado production in California, and would require those districts to be represented by a specified number of producers who are not handlers according to the number of districts the commission establishes. The bill would require the districts to be reapportioned every 5th year in accordance with redistricting procedures adopted by a two-thirds vote of the commission and concurred in by the secretary. The bill would provide for an alternate member for each district instead of providing an alternate member for each producer member of the commission. The bill would provide for 2 alternate handler members and for each alternate handler member to be assigned to serve as an alternate to two handler members, as specified, instead of providing an alternate handler member for each handler member of the commission. The bill would make conforming and other related changes.

begin insert(2)end insert Existing law, the California Salmon Marketing and Development Act, creates the California Salmon Council, consisting of 9 voting members, appointed by the Secretary of Food and Agriculture, and 5 nonvoting members, as provided. Under existing law, the council is required to provide advice and investigations for, and perform duties delegated to it by, the secretary, including programs to promote education, research, and public information regarding the consumption of salmon and salmon products. Existing law provides for referendum voting by commercial salmon vessel operators, as defined, to determine whether the act should be implemented and, periodically, to review whether the operation of the act and the council should be continued. Upon approval of the referendum, existing law requires fishermen to pay specified assessments to the secretary and requires the secretary to expend and invest those moneys for purposes of the act. A violation of the act is a misdemeanor.

This bill would change the composition of the council to include 3 nonvoting members and would make various changes to the requirements covering commercial salmon fishing, with regard to notification of the adopted regulations by the secretary.

The bill would require the secretary to establish a list of handlers, defined to include processors, receivers, and wholesalers, and would provide for referendum voting by those handlers to determine whether they shall be subject to the act. Upon approval of the referendum, the bill would change the composition of the council to include 11 voting members appointed by the secretary. Upon approval of the referendum, the bill would require fishermen who sell salmon to the ultimate consumer and handlers to pay specified assessments to the secretary and would require the secretary to expend and invest those moneys for purposes of the act, thereby making an appropriation. The bill would include handlers, if subject to the act, in the periodic referenda to determine whether the operation of the act and the council should be continued and would make other conforming changes. By authorizing handlers to be subject to the requirements of the act, the violation of which is a misdemeanor, the bill would impose a state-mandated local program.

40season, if he or she finds either one of the following:

36products in those markets.

37(b) Enable the salmon fishery to purchase, where there are
38willing sellers, the allocation rights to harvest salmon, as they may
39exist, of other salmon user groups to provide fishermen, and
40 thereby the salmon fishery, greater access to salmon stocks than

2management, or allocation agreement.

3(c) In aid, but not in limitation, of the purpose in subdivision
4(a), authorize and enable the secretary to formulate and effectuate,
5directly or in cooperation with other agencies, organizations,
6including the Oregon Salmon Commission, and instrumentalities
7that are specified in this chapter, sales stimulation and consumer
8or other educational programs designed to increase the use and
9consumption of salmon and salmon products for human
10consumption.

11(d) Provide funds for the administration and enforcement of this
12chapter by mandatory fees to be collected in the manner prescribed
13in this chapter.

24agreements with those organizations or agencies for carrying on
25joint programs of education, research, publicity, and advertising.

26(2) Recommend to the secretary the making of contracts and
27agreements with other councils, commodity commissions, or
28producer organizations for joint programs of publicity and
29advertising where those products are compatible with the promotion
30of salmon and salmon products.

31(3) In matters of research, cooperate with organizations of
32recognized professional standing that are adequately equipped
33with facilities for the research that is contemplated.

34(h) Recommend to the secretary the institution and promotion
35of scientific research to develop or discover, or both, the health,
36food, therapeutic, dietetic, and other uses of salmon.

37(i) (1) Receive, invest, and disburse funds pursuant to Article
388 (commencing with Section 76900).

39(2) Allocate funds to agencies not specifically or solely engaged
40in carrying on research or promotion for salmon, if the council and

33that tend to promote increased consumption of salmon and salmon

40become subject to this chapter pursuant to Article 9.5 (commencing
P20   1with Section 76961), shall also pay the fee specified in paragraph
2(1) of subdivision (b) for each pound, or fraction thereof, of salmon
3taken and sold by the fisherman to the ultimate consumer. The
4fees shall be remitted to the secretary by the fisherman.

5(b) (1) Every handler subject to this chapter pursuant to Article
69.5 (commencing with Section 76961) shall pay the fee specified
7in Sections 76902 and 76905 for each pound, or fraction thereof,
8of salmon received from a fisherman. The fee shall be remitted to
9the secretary by the handler.

10(2) Every handler subject to this chapter pursuant to Article 9.5
11(commencing with Section 76961) shall pay the fee specified in
12paragraph (1) and shall also pay the fee specified in paragraph (1)
13of subdivision (a) for each pound, or fraction thereof, of salmon
14that the handler has caught while conducting the activities of a
15commercial fisherman for his or her own processing or sale. The
16fees shall be remitted to the secretary by the handler.

23in the referendum marketed 65 percent or more of the total quantity
24of salmon landed in the preceding fiscal year by all of the
25commercial salmon vessel operators who voted in the referendum.

The secretary shall establish a period in which to
27conduct the implementation referendum that shall not be more
28than 60 days in duration, and may prescribe additional procedures
29as may be necessary to conduct the referendum. If the initial period
30established is less than 30 days, the secretary may extend that
31period. However, the total referendum period may not exceed 60
32days.

11necessary costs incurred in conducting the implementation
12referendum vote. If the commercial salmon vessel operators who
13voted in the implementation referendum voted in favor of
14implementing this article, as provided in Section 76952, the council
15shall reimburse the Commercial Salmon Stamp Account in the
16Fish and Game Preservation Fund all amounts received from that
17fund.

On or before January 31, 2016, the secretary shall
34establish a list of handlers eligible to vote on whether they shall
35be subject to this chapter. In establishing the list, the secretary may
36require that handlers provide receipts of the quantity of salmon
37received from commercial salmon vessel operators in the previous
38season. The secretary may also request the assistance of the
39Director of Fish and Wildlife in compiling the list. The request for
40the information shall be in writing and shall be subject to the

2Code. The list shall be filed within 30 days following receipt of
3the written notice.

Any handler whose name does not appear upon the
5secretary’s list of handlers may have his or her name established
6on the list by filing with the secretary a signed statement,
7identifying himself or herself as a handler. Failure to be on the list
8does not exempt a handler from paying assessments under this

11secretary finds in a referendum conducted by the secretary under
12this article that at least 40 percent of the total number of handlers

17referendum voted in favor of being subject to this chapter, and the
18handlers who voted in the referendum handled 51 percent or more

22referendum voted in favor of being subject to this chapter, and the
23handlers who voted in the referendum marketed 65 percent or more
24of the total quantity of salmon landed in the preceding fiscal year
25by all of the handlers who voted in the referendum.

21shall, by the public hearing procedure, and if appropriate, the
22procedure specified in this article, determine whether the council
23program provided for in this chapter shall continue in effect.

24(b) If the secretary finds from evidence received at the hearing
25that a substantial question exists as to whether the council program
26is contrary to or does not effectuate the declared purposes or
27provisions of this chapter or receives in writing a referendum
28petition with the signatures of 25 percent or more of the number
29of commercial salmon vessel operators who made landings in the
30previous year, as evidenced by receipts prepared under Section
318043 of the Fish and Game Code, and, if applicable, 25 percent or
32more of the handlers who are subject to this chapter, the council
33program shall be submitted to referendum as provided in this
34article.

If the secretary determines that a referendum procedure
36is appropriate, the secretary shall establish a referendum period of
37not to exceed 30 days during which period ballots shall be
38submitted to every commercial salmon vessel operator and, if
39applicable, every handler subject to this chapter on a statewide

14and who harvested 51 percent or more of the total amount of

19salmon vessel operators and handlers, who voted in the review
20referendum and who harvested 65 percent or more of the total
21amount of salmon landed during the previous fiscal year by all

23the review referendum, approve the program.

(a) This chapter shall continue if commercial salmon
25vessel operators and handlers vote for continuation in accordance
26with the requirements of this article.

27(b) This chapter shall not continue in operation if commercial
28salmon vessel operators and handlers vote not to continue in

31and handlers do not vote for continuation, or if handlers vote for

4handlers vote to terminate the council pursuant to Article 10
5(commencing with Section 76971), the council shall remain in
6existence for the purpose of furnishing the secretary with a
7complete record of its outstanding financial obligations, accrued
8and to accrue. The secretary shall pay from the money deposited
9and disbursed any outstanding obligations and any obligations
10incurred by the secretary and the department under the terms and
11provisions of this section. Any money that remains shall be retained
12by the secretary to defray the expenses of formulation, issuance,
13administration, or enforcement of any subsequent program for
14salmon promotion. If no such program is undertaken within a
15period of three years from the date of termination of the council,
16that money shall be withdrawn from the approved depository and
17paid into the special account for enhancement and restoration
18programs established pursuant to Section 7861 of the Fish and
19Game Code.
