To the Members of the California State Assembly:

I am returning Assembly Bill 1050 without my signature.

This bill requires employers seeking a permanent variance from an
elevator safety order to notify the union representing elevator
workers in the region where the building is located and to also
notify the workers who will be performing the work. The bill also
requires the Occupational Safety and Health Standard Board to grant
party status to affected workers, or their authorized representative,
to participate in the variance proceedings.

As I noted last year, the board routinely works with stakeholders to
provide timely written notice of a variance request and permits those
parties to intervene in the proceedings. I continue to believe that
the existing process is one that provides adequate opportunity for
interested and affected workers to be heard.
