AB 1099, as amended, Olsen. School accountability: local control and accountability plans: teacher evaluations.
(1) Existing law required, on or before July 1, 2014, the governing boards of school districts and county boards of education to adopt a local control and accountability plan using a template adopted by the State Board of Education. Existing law requires the governing board of each school district and each county board of education to update its local control and accountability plan before July 1 of each year. Existing law requires an update to include, among other things, a listing and description of the expenditures for the fiscal year, as specified.
This bill would instead require that the annual update to a school district’s local control and accountability plan include a listing and description of the expenditures at the school district level and by schoolsite for the fiscal year, as specified. The bill would also require that the annual update to a county board of education’s local control and accountability plan include a listing and description of the expenditures at the county level and by schoolsite for the fiscal year, as specified. By imposing additional duties on local educational agencies, this bill would impose a state-mandated local program.
(2) Existing law requires the governing board of each school district to establish standards of expected pupil achievement at each grade level in each area of study and to evaluate and assess certificated employee performance on a continuing basis as it reasonably relates to the progress of pupils toward the established standards and, if applicable, the state adopted academic content standards as measured by state adopted criterion referenced assessments, the instructional techniques and strategies used by the employee, the employee’s adherence to curricular objectives, and the establishment and maintenance of a suitable learning environment, within the scope of the employee’s responsibilities.
This bill would require the superintendent of a school district and a county superintendent of schools to make available to the public, and post on its Internet Web site, if it has one, specified information relating to the evaluation of teachers and principals. By imposing additional duties on local educational agencies, this bill would impose a state-mandated local program.
(3) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

The people of the State of California do enact as follows:
Section 44664.5 is added to the Education Code,

(a) The superintendent of a school district shall make

6(1) An easily understandable explanation of how the evaluation
7of certificated teaching staff is conducted, including, but not limited
8to, all blank evaluation forms, all procedures to be used for the
9evaluation of certificated teachers contained in the current
P3 1collective bargaining agreement, how evaluations include the
2progress of pupils toward the locally adopted standards of expected
3pupil achievement at each grade level in each area of study, and,
4if applicable, the state adopted academic
content standards as
5measured by state adopted criterion referenced assessments.
6(2) Aggregate data on the number of certificated teachers at
7each schoolsite that receive satisfactory or unsatisfactory
8evaluations, unless the posting of this data would reveal personally
9identifiable information.

Section 52061 of the Education Code is amended to
35read:
(a) On or before July 1, 2015, and each year thereafter,
37a school district shall update the local control and accountability
38plan. The annual update shall be developed using a template
39developed pursuant to Section 52064 and shall include all of the
40following:
P4 1(1) A review of any changes in the applicability of the goals
2described in paragraph (1) of subdivision (c) of Section 52060.
3(2) A review of the progress toward the goals included in the
4existing local control and accountability plan, an assessment of
5the effectiveness of the specific actions described in the existing
6local control and accountability plan toward
achieving the goals,
7and a description of changes to the specific actions the school
8
district will make as a result of the review and assessment.
9(3) A listing and description of the expenditures at the school
10district level and by schoolsite for the fiscal year implementing
11the specific actions included in the local control and accountability
12plan and the changes to the specific actions made as a result of the
13reviews and assessment required by paragraphs (1) and (2).
14(4) A listing and description of expenditures at the school district
15level and by schoolsite for the fiscal year that will serve the pupils
16to whom one or more of the definitions in Section 42238.01 apply
17and pupils redesignated as fluent English proficient.
18(b) The expenditures identified in subdivision (a) shall be
19classified using
the California School Accounting Manual pursuant
20to Section 41010.
Section 52067 of the Education Code is amended to
22read:
(a) On or before July 1, 2015, and each year thereafter,
24a county board of education shall update the local control and
25accountability plan. The annual update shall be developed using
26a template developed pursuant to Section 52064 and shall include
27all of the following:
28(1) A review of any changes in the applicability of the goals
29described in paragraph (1) of subdivision (c) of Section 52066.
30(2) A review of the progress toward the goals included in the
31existing local control and accountability plan, an assessment of
32the effectiveness of the specific actions described in the existing
33local control and accountability plan
toward achieving the goals,
34and a description of changes to the specific actions the county
35office of education will make as a result of the review and
36assessment.
