An act to amend Section 42649.8 of the Public Resources Code, relating to solid waste.

AB 1103, as amended, Dodd. Solid waste: organic waste.

Existing law, on and after April 1, 2016, requires a business that generates a certain amount of organic waste to arrange for recycling services specifically for organic waste, and requires each city, county, or regional agency approved by the Department of Resources Recycling and Recovery to implement an organic waste recycling program designed to divert organic waste generated by those businesses, except as specified. Existing law defines the term “organic waste” for purposes of those provisions to include food waste and food-soiled paper waste.

This bill would also define the terms “food-soiled paper” and “food waste” for purposes of those provisions.

SECTION 1.  

Section 42649.8 of the Public Resources Code
2 is amended to read:

42649.8.  

For purposes of this chapter, the following terms shall
4apply:

P2    1(a) “Business” means a commercial or public entity, including,
2but not limited to, a firm, partnership, proprietorship, joint stock
3company, corporation, or association that is organized as a
4for-profit or nonprofit entity, or a multifamily residential dwelling.

5(b) “Commercial waste generator” means a business subject to
6subdivision (a) of Section 42649.2.

8 food soiled napkins, towels, egg cartons, pizza boxes, waxedbegin insert or
9unwaxedend insert

11coffee filters, tea bags, and plates and cups that do not have a
12plastic coating.end insert

13(d) “Food waste” means discardedbegin insert putrescibleend insert solid, semisolid,
14and liquid food,begin delete includingend deletebegin insert including, but not limited to,end insert fruit,
15vegetables, cheese, meat, bones, poultry, seafood, bread, rice,
16pasta,begin delete and oils; coffee filters and tea bags; cut flowers and herbs;end delete
17begin insert oils, and herbs,end insert and anybegin insert otherend insert putrescible matter produced from
18humanbegin delete or animalend delete foodbegin delete production, preparation, and consumptionend delete
19begin insert production and preparationend insert activities. Food waste includes
20 food-soiled paper.begin insert Food waste does not include materials required
21to be handled pursuant to Chapter 5 (commencing with Section
2219200) of Part 3 of Division 9 of the Food and Agricultural Code.end insert

23(e) “Organic waste” means food waste, green waste, landscape
24and pruning waste, nonhazardous wood waste, and food-soiled
25paper waste that is mixed in with food waste.

26(f) “Organic waste generator” means a business subject to
27subdivision (a) of Section 42649.81.

28(g) “Rural jurisdiction” means a jurisdiction that is located
29entirely within one or more rural counties, or a regional agency
30comprised of jurisdictions that are located within one or more rural
31counties.

32(h) “Rural county” means a county that has a total population
33of less than 70,000 persons.

34(i) “Self-hauler” means a business that hauls its own waste rather
35than contracting for that service and “self-haul” means to act as a
36self-hauler.
