An act to amend Section 164.53 of the Streets and Highways Code, relating to transportation.

Existing law provides various sources of funding for transportation projects. Existing law authorizes the California Transportation Commission to approve advance expenditures by local agencies of local funds relative to certain transportation projects that have been designated to receive future funds from the state when those funds become available.

This bill would make a nonsubstantive change to these provisions.

The people of the State of California do enact as follows:

SECTION 1.  

Section 164.53 of the Streets and Highways Code
2 is amended to read:

164.53.  

(a) A local agency may request authorization from
4the commission to make advance expenditures of funds, other than
5state or federal funds, for a projectbegin delete whichend deletebegin insert thatend insert is included in the
6priority list for the allocation of transit capital improvement funds
7pursuant to Section 99317 of the Public Utilities Code, or is
8included in the adopted state transportation improvement program,
P2    1or is specifically authorized by Chapter 3 (commencing with
2Section 99620) of Part 11.5 of Division 10 of the Public Utilities
3Code.

4(b) If the commission approves a request submitted pursuant to
5 subdivision (a), the approved advance expenditures shall be
6considered either part of the nonfederal share of project costs, or
7part of the match from public or private sources, for projectsbegin delete whichend delete
8begin insert thatend insert are included in the transit capital improvement program
9pursuant to Section 99317 of the Public Utilities Code, or included
10in the state transportation improvement program, or which are
11authorized by Chapter 3 (commencing with Section 99620) of Part
1211.5 of Division 10 of the Public Utilities Code.

13(c) The commission’s approval of a request pursuant to
14subdivision (b) does not, in and of itself, constitute an obligation
15to allocate state funds for the project.

16(d) The commission, in consultation with the department and
17local transportation officials, shall develop and adopt guidelines
18to implement this section. The guidelines shall include a
19requirement that the advance expenditure of funds will result in
20the completion of an operable segment of a transportation project.
21The acquisition of right-of-way needed either for a usable urban
22or commuter rail project or an operable segment of an urban or
23commuter rail project meets that requirement.

24(e) The commission shall prepare a report on the progress and
25impact of the advance expenditure program authorized by this
26section and shall include the report as an element of the annual
27report to the Legislature required pursuant tobegin delete Sections 14535 and

of the Government Code.
