An act to amend Section 49452 of the Education Code, relating to pupil health.

LEGISLATIVE COUNSEL’S DIGEST

AB 1120, as introduced, Santiago. Pupil health: sight and hearing tests.

Existing law requires the governing board of any school district to provide for the adequate testing of sight and hearing of each pupil enrolled in the schools of the district to be given only by specified persons.

This bill would make nonsubstantive changes to that provision.

The people of the State of California do enact as follows:

SECTION 1.  

Section 49452 of the Education Code is amended
2to read:

49452.  

The governing board ofbegin delete anyend deletebegin insert aend insert school district shall,
4subject to Section 49451, provide for the testing of the sight and
5hearing of each pupil enrolled inbegin delete the schoolsend deletebegin insert a schoolend insert of thebegin insert schoolend insert
6 district. The test shall be adequate in nature and shall be given
7only bybegin delete dulyend delete qualified supervisors of health employed by thebegin insert schoolend insert
8 district;begin delete orend delete by certificated employees of thebegin insert schoolend insert district or of
9the county superintendent of schools who possess the qualifications

2Licensing;begin delete orend delete by contract with an agencybegin delete dulyend delete authorized to
3perform those services by the county superintendent of schools of
4the county in which thebegin insert schoolend insert district is located, under guidelines
5established by thebegin delete State Board of Education;end deletebegin insert state board;end insert orbegin insert by
6contract withend insert
accredited schools or colleges of optometry,
7osteopathic medicine, or medicine. The records of the tests shall
8serve as evidence of the need of the pupils for the educational
9facilities provided physically handicapped individuals. The
10equipment necessary to conduct the tests may be purchased or
11rented by governing boards of school districts. The state, any
12agency, or political subdivision thereof may sell or rentbegin delete any suchend delete
13 equipment owned by it to the governing board ofbegin delete anyend deletebegin insert aend insert school
14district upon terms as may be mutually agreeable.
