Existing law establishes a system of public elementary and secondary schools in this state, and authorizes local educational agencies throughout the state to operate schools and provide instruction to pupils in kindergarten and grades 1 to 12, inclusive. Existing regulations require schools to have their heating, ventilation, and air conditioning systems inspected at least annually.
This bill would requirebegin delete each public school maintaining kindergarten or any of grades 1 to 12, inclusive, to post a copy of anyend deletebegin insert the most recent date of aend insert heating, ventilation, and air conditioning system inspection reportbegin delete on itsend deletebegin insert
and information on how the report may be obtained to be posted on theend insert Internet Web sitebegin delete and on the Internet Web site of its school district or county office of education, as applicable.end deletebegin insert of certain local educational agencies.end insert The bill would also state related findings and declarations of the Legislature. By imposing additional duties on local educational agencies, this bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

The people of the State of California do enact as follows:
The Legislature finds and declares all of the
2following:
3(a) Many pupils and staff members in California’s public schools
4have a variety of respiratory illnesses such as asthma.
5(b) Many schools are located in agricultural areas, industrial
6areas, or areas that have an unsafe level of air pollution.
7(c) Many pupils andbegin insert schoolend insert staff learn and work in portable
8classrooms or offices that are extremely vulnerable to rot, mold,
9and other airborne
pathogens.
10(d) California’s public schools are required to have an annual
11inspection of their heating, ventilation, and air conditioning
12systems.
13(e) California’s public schools are authorized to reserve funding
14for facility repairs as a condition of participating in the school
15facilities program under existing law.
16(f) The documentation of these inspections is often not easily
17available for review bybegin insert schoolend insert staff, parents, or pupils to make
18sure that the inspections are being carried out in accordance with
19existing law.
Section 17583 is added to the Education Code, to read:
