SUMMARY:
This bill establishes statutory requirements specific to
pediatric day health and respite care facilities (PDHRCFs),
which are currently governed under regulations applicable to a
licensure category.

It also allows these facilities to establish Transitional Health
Care Needs Optional Service Units to serve individuals over 21,
and establishes a licensure and fee structure for this category.
FISCAL EFFECT:
1)Minor one-time costs to the California Department of Public
Health (CDPH) Licensing and Certification Division to revise
policies and procedures to be compliant with this bill.
2)Minor fee-supported workload costs to license Transitional
Health Care Needs Optional Service Units as authorized by this
bill.
COMMENTS:
Purpose. According to the author, medically fragile children, as
they begin to approach the age of 22, have been faced with
untenable choices of how to cobble together the types of
services that could provide the same type of care and support
received at PDHRCFs. The author states this bill will guarantee
the continuity of care this population desperately needs by
allowing medically fragile children and young adults to continue
to receive the quality services from PDHRCFs as they grow older
than the age of 22. This bill is supported by businesses that
operate PDHRCFs.
The need for the prescriptive language in this bill is
associated with CDPH's failure to promulgate regulations
specific to this facility type despite statutory direction to

adopt regulations by July 1, 1993. CDPH does not have plans to
adopt such regulations. In the absence of regulations, PDHRCFs
have been governed by more stringent regulations for skilled
nursing facilities.
