Existing lawbegin delete required,end deletebegin insert requires,end insert on or before July 1, 2014, the governing boards of school districts and county boards of education to adopt a local control and accountability plan using a state template adopted by the State Board of Education. Existing law requires the local control and accountability plan to include, among other things, a description of annual goals for all pupils and specified subgroups of pupils to be achieved for each state priority, as specified, and a description of the specific actions the school district or county superintendent of schools will take to achieve those goals. Existing law requires the state board, on or before October 1, 2015, to adopt evaluation rubricsbegin delete to,end deletebegin insert

By imposing additional duties on school district and county office of education officials, the bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

(a) On or before March 31, 2014, the state board shall
4adopt templates for the following purposes:
P3 1(1) For use by school districts to meet the requirements of
2Sections 52060 to 52063, inclusive.
3(2) For use by county superintendents of schools to meet the
4requirements of Sections 52066 to 52069, inclusive.
5(3) For use by charter schools to meet the requirements of
6Section 47606.5.
7(b) The templates developed by the state board shall allow a
8school district, county superintendent of schools, or charter school
9to complete a single local control and accountability plan to
meet
10the requirements of this article and the requirements of the federal
11No Child Left Behind Act of 2001 related to local educational
12agency plans pursuant to Section 1112 of Subpart 1 of Part A of
13Title I of Public Law 107-110. The state board shall also take steps
14to minimize duplication of effort at the local level to the greatest
15extent possible. The template shall include guidance for school
16districts, county superintendents of schools, and charter schools
17to report both of the following:
18(1) A listing and description of expenditures for the 2014-15
19fiscal year, and each fiscal year thereafter, implementing the
20specific actions included in the local control and accountability
21plan.
22(2) A listing and description of expenditures for the 2014-15
23fiscal year, and each fiscal year thereafter, that will serve the pupils
24to whom one or more of the definitions in Section 42238.01
apply
25and pupils redesignated as fluent English proficient.
26(c) If possible, the templates identified in paragraph (2) of
27subdivision (a) for use by county superintendents of schools shall
28allow a county superintendent of schools to develop a single local
29control and accountability plan that would also satisfy the
30requirements of Section 48926.
31(d) The state board shall adopt the template pursuant to the
32requirements of the Administrative Procedure Act (Chapter 3.5
33(commencing with Section 11340) of Part 1 of Division 3 of Title
342 of the Government Code). The state board may adopt emergency
35regulations for purposes of implementing this section. The adoption
36of emergency regulations shall be deemed an emergency and
37necessary for the immediate preservation of the public peace,
38health, safety, or general welfare.
39(e) Notwithstanding subdivision (d), the state board may adopt
40the template in accordance with the requirements of the
P4 1Bagley-Keene Open Meeting Act (Article 9 (commencing with
2Section 11120) of Chapter 1 of Part 1 of Division 3 of Title 2 of
3the Government Code). When adopting the template pursuant to
4the requirements of the Bagley-Keene Open Meeting Act, the state
5board shall present the template at a regular meeting and may only
6take action to adopt the template at a subsequent regular meeting.
7This subdivision shall become inoperative on January 31, 2018.
8(f) Revisions to a template or evaluation rubric shall be approved
9by the state board by January 31 before the fiscal year during which
10the template or evaluation rubric is to be used by a school district,
11county superintendent of schools, or charter school.
12(g) On or before January 31, 2017, the state board shall
13consider a revision to the template to include a section or appendix
14sufficient to monitor actual progress on outcomes adopted pursuant
15to subdivision (c) of Section 52064.5.

18board shall not create a requirement for a governing board of a
19school district, a county board of education, or a governing body
20of a charter school to submit a local control and accountability
21plan to the state board, unless otherwise required by federal law.
22The Superintendent shall not require
a local control and
23accountability plan to be submitted by a governing board of a
24school district or the governing body of a charter school to the
25state board. The state board may adopt a template or evaluation
26rubric that would authorize a school district or a charter school to
27submit to the state board only the sections of the local control and
28accountability plan required by federal law.
Section 52065 of the Education Code is amended to
31read:
(a) The superintendent of a school district shall post
33on the Internet Web site of the school district any local control and
34accountability plan approved by the governing board of the school
35district, any updates or revisions to a local control and
36accountability plan approved by the governing board of the school
37district, andbegin insert, if available,end insert the school district’sbegin insert populatedend insert evaluation
38rubricbegin delete data.end deletebegin insert unless the state board
revises the template for the local
39control and accountability plan pursuant to subdivision (g) of
40Section 52064.end insert

2following:
3(1) Post on the Internet Web site of the county office of
4education any local control and accountability plan approved by
5the county board of education, any updates or revisions to a local
6control and accountability plan approved by the county board of
7education, andbegin insert, if available,end insert the county office of education’s
8begin insert populatedend insert evaluation rubricbegin delete data.end deletebegin insert
unless the state board revises
9the template for the local control and accountability plan pursuant
10to subdivision (g) of Section 52064.end insert
11(2) Post all local control and accountability plans submitted by
12schoolbegin delete districts and the school
district’s evaluation rubric data,end delete
13begin insert districts,end insert or links to thosebegin delete plans and data,end deletebegin insert plans,end insert on the Internet
14Web site of the county office of education.
15(3) Transmit or otherwise make available to the Superintendent
16all local control and accountability plans submitted to the county
17superintendent of schools by school districts and the local control
18and accountability plan approved by the county board of education.
19(c) The Superintendent shall post links to all local control and
20accountability plans approved by the
governing boards of school
21districts and county boards ofbegin delete education, the evaluation rubrics begin insert
educationend insert on the
22adopted by the state board, and each school district’s and county
23office of education’s evaluation rubric dataend delete
24Internet Web site of the department.
If the Commission on State Mandates determines that
27this act contains costs mandated by the state, reimbursement to
28local agencies and school districts for those costs shall be made
29pursuant to Part 7 (commencing with Section 17500) of Division
304 of Title 2 of the Government Code.
