   An act to add Section 42872.3 to the Public Resources Code,
relating to tire recycling.

   AB 1159, as introduced, Gordon. Tire recycling: incentive program.

   The California Tire Recycling Act requires a person who purchases
a new tire to pay a California tire fee, for deposit in the
California Tire Recycling Management Fund, for expenditure by the
Department of Resources Recycling and Recovery upon appropriation by
the Legislature, to pay the costs of operating a tire recycling
program. The act provides that the tire recycling program may
include, among other things, the development and implementation of a
waste tire incentive payment program to promote increased demand for
waste tires recycled in this state and to promote higher valued
products.
   This would require the department, as part of the tire recycling
program, to establish a waste tire recycling incentive program
designed to achieve, by January 1, 2018, a 75% recycling rate for
waste tires generated in California.
   Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 42872.3 is added to the Public Resources Code,
to read:
   42872.3.  In accordance with the tire recycling program
established pursuant to this article, the department shall establish
a waste tire recycling incentive program designed to achieve, by
January 1, 2018, a 75 percent recycling rate for waste tires
generated in California.
