SUMMARY:
This bill revises the definition of "key employee" in the
Gambling Control Act to add shift manager, surveillance manager,
and surveillance supervisor to the nonexhaustive list of example
key employees, and deletes pit boss and shift boss from that
list.
FISCAL EFFECT:
Minor and absorbable costs to the Gambling Control Commission
and Department of Justice.

COMMENTS:
1)Purpose. The Gambling Control Act requires key employees to
be licensed by the Gambling Control Commission (GCC) in order
to work in licensed gambling operations, including card clubs.
This bill revises the definition of key employee in the
Gambling Control Act to include surveillance manager and
surveillance supervisor. According to the author, these
persons play key roles in the security, oversight, and
investigations of card club activities. AB 1188 also deletes
the terms pit boss and shift boss from the definition,
replacing them with shift manager. The author asserts the
terms pit boss and shift boss are generally used in Nevada
casinos but not California card clubs.
2)Substantive Change? The Gambling Control Act broadly defines
key employee as "any natural person employed in the operation
of a gambling enterprise in a supervisory capacity or
empowered to make discretionary decisions that regulate
gambling operations?". The amendments proposed in AB 1188
clarify some of the nonexhaustive examples of a key employee,
but do not change the meaning of the definition. At present,
the GCC may designate any person in a "supervisory capacity"
or "empowered to make discretionary decisions" as a key
employee, regardless of job title.
