An act to amend Sections 33530 and 33532 of the Education Code, relating to the Instructional Quality Commission.

SECTION 1.  

Section 33530 of the Education Code is amended
2to read:

33530.  

(a) There is in the state government the Instructional
4Quality Commission consisting of a Member of the Assembly
5appointed by the Speaker of the Assembly, a Member of the Senate
6appointed by the Senate Committee on Rules, one public member
7appointed by the Speaker of the Assembly, one public member
8appointed by the Senate Committee on Rules, one public member
9appointed by the Governor, andbegin delete 14end deletebegin insert 13end insert public members appointed
10by the state board upon the recommendation of the Superintendent
11or the members of the state board.

12(b) So far as is practical and consistent with the duties assigned
13to the commission by the state board, at leastbegin delete eightend deletebegin insert sevenend insert of thebegin delete 14end delete
14begin insert 13end insert public members appointed by the state board shall bebegin delete persons,
15whoend delete
begin insert persons who,end insert because they have taught, written, or lectured
16on the subject matter fields specified in Section 33533, in the
17course of public or private employment, have become recognized
18 authorities or experienced practitioners in those fields. The state
19board shall make its appointments to ensure that, at any one time,

21classroom teachers, or mentor teachers, or both assigned to teach
22kindergarten or any of grades 1 to 12, inclusive.

25teachers, current members of the commission who were appointed

2board to consider appointing a pupil to the commission, using the
3current appointment process.

4(2) Notwithstanding Section 1020 of the Government Code,begin insert if
5the state board elects to appoint a pupil to the commission,end insert

7commences, a pupil enrolled in good standing in a public high

9(3) The pupil member shall be chosen from among the two
10finalist candidates not chosen for nomination as the student member
11on the state board pursuant to Section 33000.5.

12(A) The pupil has been enrolled in a California high school for
13a minimum of two consecutive years.

14(B) The pupil is in good standing.

15(e) In making the remaining appointments to the commission,
16and in establishing the commission’s advisory task forces or
17committees, the state board is encouraged to consider the role of
18other representatives of the educational community in the
19development of curriculum and instructional materials, including,
20but not limited to, administrators, governing school board members,
21begin insert pupils,end insert and parents who are reflective of the various ethnic groups
22and types of school districts in California.

SEC. 2.  

Section 33532 of the Education Code is amended to
24read:

33532.  

(a) (1) Except as provided in paragraph (2), each
26commission member shall serve for a four-year term and shall not
27be eligible to serve more than one full term. Prior service on the
28commission for a term of less than three years resulting from an
29initial appointment or an appointment for the remainder of an
30unexpired term shall not be counted as a full term.

31(2) A pupil member of the commission shall serve for a one-year
32term and shall not be eligible to serve more than one full term. The
33pupil member shall be a voting member with the full rights and
34duties of the other members of the commission.

35(b) With respect to the appointment of 13 public members by
36the state board to the first commission, four shall be appointed for
37terms of two years, four shall be appointed for terms of three years,
38and five shall be appointed for a term of four years.
