AB 1206, as introduced, Chu. School accountability: local control and accountability plans: California Collaborative for Educational Excellence.
Existing law, on or before July 1, 2014, requires the governing board of each school district and each county board of education to adopt a local control and accountability plan and requires the governing board of each school district and each county board of education to update its local control and accountability plan on or before July 1 of each year. Existing law requires the local control and accountability plan to include certain elements, and requires the charter for a charter school to include some of those same elements.
Existing law establishes the California Collaborative for Educational Excellence for purposes of advising and assisting school districts, county superintendents of schools, and charter schools in achieving the goals set forth in a local control and accountability plan. Existing law requires the collaborative to be governed by a board consisting of 5 members, as specified.
This bill would add a governing board member of a school district appointed by a majority of the board members of the collaborative to the governing board of the collaborative.
Existing law authorizes the Superintendent of Public Instruction to direct the collaborative to advise and assist a school district, county superintendent of schools, or charter school in specified circumstances.
This bill would also authorize the Superintendent to direct the collaborative to advise and assist a school district if the state-appointed trustee or administrator of the school district requests that advice and assistance.

The people of the State of California do enact as follows:
Section 52074 of the Education Code is amended
2to read:
(a) The California Collaborative for Educational
4Excellence is hereby established.
5(b) The purpose of the California Collaborative for Educational
6Excellence is to advise and assist school districts, county
7superintendents of schools, and charter schools in achieving the
8goals set forth in a local control and accountability plan adopted
9pursuant to this article.
10(c) The Superintendent shall, with the approval of the state
11board, contract with a local educational agency, or consortium of
12local educational agencies, to serve as the fiscal agent for the
13California Collaborative for Educational Excellence. The
14Superintendent shall apportion funds appropriated for the California
15Collaborative for
Educational Excellence to the fiscal agent.
16(d) The California Collaborative for Educational Excellence
17shall be governed by a board consisting of the followingbegin delete fiveend deletebegin insert sixend insert
18 members:
19(1) The Superintendent or his or her designee.
20(2) The president of the state board or his or her designee.
21(3) A county superintendent of schools appointed by the Senate
22Committee on Rules.
23(4) A teacher appointed by the Speaker of the Assembly.
24(5) A
superintendent of a school district appointed by the
25 Governor.
26(6) A governing board member of a school district appointed
27by a majority of the board members of the California Collaborative
28for Educational Excellence.
P3 1(e) At the direction of the governing board of the California
2Collaborative for Educational Excellence, the fiscal agent shall
3contract with individuals, local educational agencies, or
4organizations with the expertise, experience, and a record of
5success to carry out the purposes of this article. The areas of
6expertise, experience, and record of success shall include, but are
7not limited to, all of the following:
8(1) State priorities as described in subdivision (d) of Section
952060.
10(2) Improving the quality of teaching.
11(3) Improving the quality of school district and schoolsite
12leadership.
13(4) Successfully addressing the needs of special pupil
14populations, including, but not limited to, English learners, pupils
15eligible to receive a free or reduced-price meal, pupils in foster
16care, and individuals with exceptional needs.
17(f) The Superintendent may direct the California Collaborative
18for Educational Excellence to advise and assist a school district,
19county superintendent of schools, or charter school in any of the
20following circumstances:
21(1) If the governing board of a school district, county board of
22education, or governing bodybegin delete orend deletebegin insert
ofend insert a charter school requests the
23advice and assistance of the California Collaborative for
24Educational Excellence.
25(2) If the county superintendent of schools of the county in
26which the school district or charter school is located determines,
27following the provision of technical assistance pursuant to Section
2852071 orbegin delete 47607.3end deletebegin insert 47607.3,end insert as applicable, that the advice and
29assistance of the California Collaborative for Educational
30Excellence is necessary to help the school district or charter school
31accomplish the goals described in the local control and
32accountability plan adopted pursuant to this article.
33(3) If the Superintendent determines that the
advice and
34assistance of the California Collaborative for Educational
35Excellence is necessary to help the school district, county
36superintendent of schools, or charter school accomplish the goals
37set forth in the local control and accountability plan adopted
38pursuant to this article.

2district requests the advice and assistance of the California
3Collaborative for Educational Excellence.
