Existing law requires the legislative body to establish a public financing authority, defined as the governing board of the enhanced infrastructure financing authority, comprised of members of the legislative body of the participating entities and of the public, as provided.

The people of the State of California do enact as follows:

(a) Notwithstanding any other law, the University of
4California and the City of Richmond, and any other public agency,
5may enter into a joint powers agreement for the purpose of
6collaboration on the development of a Berkeley Global Campus
7at Richmond Bay, located within the City of Richmond, to be a
8new research and action hub with a focus on global issues, culture,
9and collaboration.
10(b) The agreement between the University of California and the
11City of Richmond, and any other public agency pursuant to
12subdivision (a) shall state the purpose of the agreement or the
13power to be exercised, and may include any of the following:
14(1) A voluntary local-hire goal, to be based on the
University
15of California, San Francisco, local-hire model, for all construction
16and infrastructure improvements, taking into consideration
17local-hire practices within the City of Richmond.
18(2) Development of strategies that assist all small businesses,
19including, but not limited to, small businesses with a high-level of
20participation by women, minorities, and veterans, respond more
21effectively to available contract opportunities for the development
22of the proposed Berkeley Global Campus at Richmond Bay.
23(3) A requirement for third-party developers to pay prevailing
24wages for construction contracts and meet the local-hire goals of
25the University of California, Berkeley, on buildings that will be
26substantially occupied by the University of California, Berkeley.
27(4) Development of best practices for proactive outreach
and
28marketing of procurement and employment opportunities for the
29residents of the City of Richmond at the proposed Berkeley Global
30Campus at Richmond Bay.
P3 1(5) Development of strategies to work with community
2organizations, small business development programs, and
3workforce training programs to assist the residents of the City of
4Richmond respond effectively to opportunities at University of
5California campuses and at the proposed Berkeley Global Campus
6at Richmond Bay.
7(6) Collaboration with the Department of Employment and
8Training of the City of Richmond to access contact and
9work-readiness information for qualified trades workers and
10apprentices located within the City of Richmond.
The Legislature finds and declares that a special law
12is necessary and that a general law cannot be made applicable
13within the meaning of Section 16 of Article IV of the California
14Constitution because of the unique circumstances of developing
15the Berkeley Global Campus at Richmond Bay, located within the
16City of Richmond.
Section 53398.51.1 of the Government Code is
18amended to read:
(a) The public financing authority shall have a
20membership consisting of one of the following, as appropriate:
21(1) If a district has only one participating affected taxing entity,
22the public financing authority’s membership shall consist of three
23members of the legislative body of the participating entity, and
24two members of the public chosen by the legislative body. The
25appointment of the public members shall be subject to Section
2654974.
27(2) If a district has two or more participating affected taxing
28entities, the public financing authority’s membership shall consist
29of a majority of members from the legislative bodies of
the
30participating entities, and a minimum of two members of the public
31chosen by the legislative bodies of the participating entities. The
32appointment of the public members shall be subject to Section
3354974.
34(b) The legislative body shall ensure the public financing
35authority is established prior to adopting a resolution pursuant to
36Section 53398.69 to adopt an infrastructure financing plan and to
37form a district.
38(c) Members of the public financing authority established
39pursuant to this chapter shall not receive compensation but may
40receive reimbursement for actual and necessary expenses incurred
P4 1in the performance of official duties pursuant to Article 2.3
2(commencing with Section 53232) of Chapter 2.
3(d) Members of the public financing authority are subject to
4Article 2.4 (commencing with Section 53234) of Chapter 2.
5(e) The public financing authority created pursuant to this
6chapter shall be a local public agency subject to the Ralph M.
7Brown Act (Chapter 9 (commencing with Section 54950)), the
8California Public Records Act (Chapter 3.5 (commencing with
9Section 6250) of Division 7 of Title 1), and the Political Reform
10Act of 1974 (Title 9 (commencing with Section 81000)).
