   An act to  amend Section 53398.51.1 of   add
Section 6531.3 to  the Government Code, relating to local
government.

   AB 1260, as amended, Thurmond.  Enhanced infrastructure
financing districts: public financing authority.   Joint
Exercise of Powers Act.  
   The Joint Exercise of Powers Act generally authorizes 2 or more
public agencies, by agreement, to jointly exercise any power common
to them under specified conditions.  
   This bill would specifically authorize the University of
California and the City of Richmond, and any other public agency, to
enter into a joint powers agreement for the purpose of collaboration
on the development of a Berkeley Global Campus at Richmond Bay,
located within the City of Richmond, to be a new research and action
hub with a focus on global issues, culture, and collaboration. 

   This bill would make legislative findings and declarations as to
the necessity of a special statute for the development of the
Berkeley Global Campus at Richmond Bay.  
   Existing law authorizes the legislative body of a city or a
county, defined to include a city and county, to establish an
enhanced infrastructure financing district, adopt an infrastructure
financing plan, and issue bonds, for which only the district is
liable, upon approval by 55% of the voters to finance public capital
facilities or other specified projects of communitywide significance.
Existing law requires the legislative body to establish a public
financing authority, defined as the governing board of the enhanced
infrastructure financing authority, comprised of members of the
legislative body of the participating entities and of the public, as
provided.  
   This bill would make nonsubstantive changes to those provisions.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 6531.3 is added to the 
 Government Code   , to read:  
   6531.3.  (a) Notwithstanding any other law, the University of
California and the City of Richmond, and any other public agency, may
enter into a joint powers agreement for the purpose of collaboration
on the development of a Berkeley Global Campus at Richmond Bay,
located within the City of Richmond, to be a new research and action
hub with a focus on global issues, culture, and collaboration.
   (b) The agreement between the University of California and the
City of Richmond, and any other public agency pursuant to subdivision
(a) shall state the purpose of the agreement or the power to be
exercised, and may include any of the following:
   (1) A voluntary local-hire goal, to be based on the University of
California, San Francisco, local-hire model, for all construction and
infrastructure improvements, taking into consideration local-hire
practices within the City of Richmond.
   (2) Development of strategies that assist all small businesses,
including, but not limited to, small businesses with a high-level of
participation by women, minorities, and veterans, respond more
effectively to available contract opportunities for the development
of the proposed Berkeley Global Campus at Richmond Bay.
   (3) A requirement for third-party developers to pay prevailing
wages for construction contracts and meet the local-hire goals of the
University of California, Berkeley, on buildings that will be
substantially occupied by the University of California, Berkeley.
   (4) Development of best practices for proactive outreach and
marketing of procurement and employment opportunities for the
residents of the City of Richmond at the proposed Berkeley Global
Campus at Richmond Bay.
   (5) Development of strategies to work with community
organizations, small business development programs, and workforce
training programs to assist the residents of the City of Richmond
respond effectively to opportunities at University of California
campuses and at the proposed Berkeley Global Campus at Richmond Bay.
   (6) Collaboration with the Department of Employment and Training
of the City of Richmond to access contact and work-readiness
information for qualified trades workers and apprentices located
within the City of Richmond. 
   SEC. 2.    The Legislature finds and declares that a
special law is necessary and that a general law cannot be made
applicable within the meaning of Section 16 of Article IV of the
California Constitution because of the unique circumstances of
developing the Berkeley Global Campus at Richmond Bay, located within
the City of Richmond.  
  SECTION 1.    Section 53398.51.1 of the Government
Code is amended to read:
   53398.51.1.  (a) The public financing authority shall have a
membership consisting of one of the following, as appropriate:
   (1) If a district has only one participating affected taxing
entity, the public financing authority's membership shall consist of
three members of the legislative body of the participating entity,
and two members of the public chosen by the legislative body. The
appointment of the public members shall be subject to Section 54974.
   (2) If a district has two or more participating affected taxing
entities, the public financing authority's membership shall consist
of a majority of members from the legislative bodies of the
participating entities, and a minimum of two members of the public
chosen by the legislative bodies of the participating entities. The
appointment of the public members shall be subject to Section 54974.
   (b) The legislative body shall ensure the public financing
authority is established prior to adopting a resolution pursuant to
Section 53398.69 to adopt an infrastructure financing plan and to
form a district.
   (c)  Members of the public financing authority established
pursuant to this chapter shall not receive compensation but may
receive reimbursement for actual and necessary expenses incurred in
the performance of official duties pursuant to Article 2.3
(commencing with Section 53232) of Chapter 2.
   (d)  Members of the public financing authority are subject to
Article 2.4 (commencing with Section 53234) of Chapter 2.
   (e)  The public financing authority created pursuant to this
chapter shall be a local public agency subject to the Ralph M. Brown
Act (Chapter 9 (commencing with Section 54950)), the California
Public Records Act (Chapter 3.5 (commencing with Section 6250) of
Division 7 of Title 1), and the Political Reform Act of 1974 (Title 9
(commencing with Section 81000)).
