An act to amend Section 38530 of the Health and Safety Code, relating to greenhouse gases.

AB 1367, as introduced, Williams. California Global Warming Solutions Act of 2006.

The California Global Warming Solutions Act of 2006 establishes the State Air Resources Board as the state agency responsible for monitoring and regulating sources emitting greenhouse gases. The act requires the state board to adopt regulations to require the reporting and verification of statewide greenhouse gas emissions and to monitor and enforce compliance with this program.

This bill would make nonsubstantive changes to the requirement that the state board adopt regulations to require the reporting and verification of statewide greenhouse gas emissions and to monitor and enforce compliance with the program.

The people of the State of California do enact as follows:

SECTION 1.  

Section 38530 of the Health and Safety Code is
2amended to read:

38530.  

(a) On or before January 1, 2008, the state board shall
4adopt regulations to require the reporting and verification of
P2    1statewide greenhouse gas emissions and to monitor and enforce
2compliance with this program.

3(b) The regulations shall do all of the following:

4(1) Require the monitoring and annual reporting of greenhouse
5gas emissions from greenhouse gas emission sources beginning
6with the sources or categories of sources that contribute the most
7to statewide emissions.

8(2) Account for greenhouse gas emissions from all electricity
9consumed in the state, including transmission and distribution line
10 losses from electricity generated within the state or imported from
11outside the state. This requirement applies to all retail sellers of
12electricity, including load-serving entities as defined in subdivision
13begin delete (j)end deletebegin insert (k)end insert of Section 380 of the Public Utilities Code and local publicly
14owned electric utilities as defined in Sectionbegin delete 9604end deletebegin insert 224.3end insert of the
15Public Utilities Code.

16(3) Where appropriate and to the maximum extent feasible,
17incorporate the standards and protocols developed by the California
18Climate Action Registry, established pursuant to Chapter 6
19(commencing with Section 42800) of Part 4 of Division 26. Entities
20that voluntarily participated in the California Climate Action
21Registry prior to December 31, 2006, and have developed a
22greenhouse gas emission reporting program, shall not be required
23to significantly alter their reporting or verification program except
24as necessary to ensure that reporting is complete and verifiable for
25the purposes of compliance with this division as determined by
26the state board.

27(4) Ensure rigorous and consistent accounting of emissions, and
28provide reporting tools and formats to ensure collection of
29necessary data.

30(5) Ensure that greenhouse gas emission sources maintain
31comprehensive records of all reported greenhouse gas emissions.

32(c) The state board shall do both of the following:

33(1) Periodically review and update its emission reporting
34requirements, as necessary.

35(2) Review existing and proposed international, federal, and
36state greenhouse gas emission reporting programs and make
37reasonable efforts to promote consistency among the programs
38established pursuant to this part and other programs, and to
P3    1streamline reporting requirements on greenhouse gas emission
2sources.
