An act to add Division 17.5 (commencing with Section 175000) to the Public Utilities Code, relating to airports.

AB 1455, as amended, Rodriguez. Ontario International Airport.

The California Airport District Act provides for creation of airport districts having responsibility for the development of airports, spaceports, and air navigation facilities within or including the territories of one or more counties or cities.

This bill would authorize the City of Ontario to issue revenue bonds, for the purpose of financing the acquisition of the Ontario International Airport from the City of Los Angeles, that are secured solely by the revenues and charges at the Ontario International Airport. The bill would require a public agency that acquires the Ontario International Airport to comply with specified conditions relating to incumbent workers, except as provided.

The people of the State of California do enact as follows:

SECTION 1.

175000.  

The City of Ontario may issue revenue bonds for the
7purpose of financing the acquisition of the Ontario International
8Airport from the City of Los Angeles. The revenue bonds shall be
9secured solely by future revenues and charges from that airport.

175001.  

(a) For purposes of this division, the public agency
11that acquires the Ontario International Airport from the City of
12Los Angeles shall be referred to as the successor agency.

13(b) The following conditions shall apply to the successor agency:

14(1) The successor agency and successor contractors shall hire
15or retain incumbent workers who have been employed for the
16preceding twelve months or longer by Los Angeles World Airports
17or contractors at the Ontario International Airport.

18(2) Incumbent workers shall be retained for a period of at least
19ninety (90) days unless there is cause to terminate their employment
20 earlier.

21(3) Incumbent workers shall be employed under the terms and
22conditions established by the successor agency and successor
23contractors, or as required by law.

24(4) The successor agency and successor contractors shall
25maintain a preferential hiring list of incumbent workersbegin insert who wereend insert
26 not initially hired or retained.

27(c) Subdivision (b) shall not apply to any of the following:

28(1) A successor contractor that is a small business that operates
29with less than ten employees.

30(2) Management positions.

31(3) Specialized skill positions.
