Existing law requires the State Water Resources Control Board to establish uniform statewide recycling criteria for each varying type of use of recycled water where the use involves the protection of public health.
This bill would require the state board, in consultation with the State Department of Public Health, the California Building Standards Commission,begin delete the Department of Housing and Community Development,end delete and stakeholders, to establish water quality standards andbegin delete ongoing monitoringend deletebegin insert distribution, monitoring,end insert and reporting requirements for onsite water recycling
systemsbegin delete using blackwater. This bill would authorize the Department of Housing and Community Development and the California Building Standards Commission to authorize the use of blackwater in onsite water recycling systems only if prescribed conditions are met.end deletebegin insert prior to authorizing the use of onsite treated water in internal plumbing of residential and commercial buildings. This bill would requireend insertbegin insert end insertbegin insertonsite treated water to be considered the same as recycled water that is produced on site.end insert
The California Building Standards Law provides for the adoption of building standards by state agencies by requiring all state agencies that adopt or propose adoption of any building standard to submit the building standard to the California Building Standards Commission for approval and adoption.

Article 8 (commencing with Section 13558) is
2added to Chapter 7 of Division 7 of the Water Code, to read:

8other water capturedbegin insert or recycledend insert onsite, that has been sourced,
9treated, and used onsite in a building in a manner that is protective
10of public health, safety, and
the environment. “Onsitebegin delete recycledend delete
11begin insert treatedend insert water” does not include anybegin delete blackwater except as provided begin insert wastewater that includes any water from a toilet,
12in Section 13559.end delete
13sewer, or septic tank unless the state board has established
14additional standards, monitoring, and reporting requirements for
15that water necessary to protect public health and safety and the
16environment.end insert
17(b) Notwithstanding any other law, onsite treated water shall
18be considered the same as recycled water that is
produced on site.

P3 1(2) A local health department may set its own monitoring and
2reporting standards for onsite recycled water using blackwater
3until the state board has established standards pursuant to this
4subdivision.
5(b) The Department of Housing and Community Development
6shall adopt building standards for all categories of
residential and
7commercial onsite recycled water.
8(c) The Department of Housing and Community Development
9and the California Building Standards Commission may authorize
10the use of blackwater in onsite water recycling systems only if
11both of the following conditions have been met:
12(1) Building standards for the use of blackwater for all categories
13of residential and commercial onsite blackwater recycling systems
14have been adopted.
15(2) The state board has developed water quality standards and
16ongoing monitoring and reporting requirements for the use of
17blackwater in onsite water recycling systems.
18(d) Until the standards described in subdivisions (a) and (b)
19have been established, a city, county, or city and county may
20authorize the use of onsite recycled
water in internal plumbing of
21residential and commercial buildings to the extent allowed by law
22prior to the addition of this section.
