Subject: Interscholastic athletics: California Interscholastic
Federation: report
SUMMARY
This bill eliminates the sunset on provisions related to the
California Interscholastic Federation (CIF), and instead
requires legislative hearings every seven years to correspond
with the release of specific reporting by the CIF.
BACKGROUND
Existing law:
1) Establishes CIF as a voluntary organization consisting
of school and school-related personnel with responsibility
for administering interscholastic athletics in high
schools. (Education Code § 33353)
2) Requires CIF to report to the Legislature and Governor
by January 1, 2016, on its evaluation and accountability
activities, including but not limited to the goals and
objectives with regard to, and the status of, all of the
following:
a) The governing structure of CIF and the
effectiveness of that structure in providing
leadership for interscholastic athletics.

b) Methods to facilitate communication with
agencies, organization, and public entities whose
functions and interests interface with CIF.
c) The quality of coaching and officiating,
including but not limited to professional development
for coaches and athletic administrators, and parent
education programs.
d) Gender equity in interscholastic athletics,
including but not limited to the number of male and
female students participating in interscholastic
athletics, and action taken by CIF in order to ensure
compliance with Title IX.
e) Health and safety of students, coaches,
officials, and spectators.
f) The economic viability of interscholastic
athletics, as specified.
g) New and continuing programs available to
student athletes.
h) Awareness and understanding of emerging issues
related to interscholastic athletics. (EC § 33353)
3) States legislative intent that California
Interscholastic Federation (CIF):
a) During years the report is not required, holds
a public comment period relating to the report at
three regularly scheduled federation council meetings
per year.
b) Annually allow public comment on the policies
and practices of CIF at a regularly scheduled
federation council meeting. (EC § 33353)
4) Sunsets the provisions described in # 1-3 on January 1,
2017. (EC § 33353)
5) Authorizes the California Department of Education to
determine if the policies of school districts and CIF are

in compliance with state and federal laws, as specified.

ANALYSIS
This bill eliminates the sunset on provisions related to the
California Interscholastic Federation (CIF), and instead
requires legislative hearings every seven years to correspond
with the release of specific reporting by the CIF.
Specifically, this bill:
1) Eliminates the January 1, 2017 sunset date on statutes
related to the CIF (see # 1-3 in Background).
2) Extends into perpetuity the requirement that the CIF repot
to the Legislature and Governor on its evaluation and
accountability activities, and requires the report to be
provided to the appropriate policy committees every seven
years, beginning January 1, 2023.
3) Requires the appropriate policy committees of the
Legislature, upon receipt of CIF's report, to hold a joint
hearing. This bill requires the CIF to testify at the
hearing and encourages members of the public to testify on
information contained in CIF's report.
STAFF COMMENTS
1) Need for the bill. According to the author, "Since 1981,
the legislature has approved CIF's sunset extension a
number of times. The last sunset extension was in 2011
which extended the sunset for another seven years. By
making current law permanent, this bill would eliminate the
need for legislation to keep extending the sunset and will
maintain all current policies and practices as well as
reporting requirements to the Legislature and Governor."
2) California Interscholastic Federation (CIF). The CIF has
adopted a constitution, bylaws, policies and guidance,
covering issues such as eligibility, appeals, rules for
each sport, and the health and safety of student athletes.
The CIF maintains resources on its website that are
specific to equity and Title IX

Information and resources include a Title IX guide, an
assessment by which schools may gauge compliance with Title
IX, and a grievance form with directions on how to file a
complaint. The CIF offers training in Title IX and sexual
harassment. Statutes have historically required the CIF to
submit a report of specified information to the Legislature
and Governor approximately one year prior to the date of
the sunset on the provisions governing the CIF. The most
recent report (December 2015) can be found on CIF's
website.

3) Significance of a sunset. The Legislature has extended the
sunset on the CIF provisions numerous times, typically
allowing a five year extension. As mentioned in this
Committee's analysis of related legislation in 2005, prior
attempts to repeal the sunset date on CIF provisions have
been met with opposition primarily concerned that there was
a lack of accountability on the part of the CIF, California
Department of Education, participating school districts and
athletic leagues in dispensing with issues raised by the
public, specifically issues relating to Title IX. The
Legislature has maintained some level of oversight by
keeping a sunset date in statute, and has required the CIF
to take certain actions prior to the consideration of
further extensions of the sunset date.
This bill would eliminate the sunset date for CIF's
authorization and extend indefinitely its authority and
responsibilities for administering high school
interscholastic athletics in California. This bill
requires the CIF to submit a report to the legislature and
Governor every seven years, and requires a legislative
hearing upon the receipt of each report. Do reports to the
Legislature and legislative hearings sufficiently serve the
purpose currently filled by sunset review?
