An act to add Section 68052.1 to the Education Code, relating to the University of California.

AB 1711, as introduced, McCarty. University of California: nonresident student enrollment.

Existing law expresses the intent of the Legislature that the University of California establish nonresident student tuition policies that are consistent with their resident student fee policies. The provisions are applicable to the University of California only if the Regents of the University of California act, by resolution, to make them applicable.

This bill would require the University of California, as a condition of receipt of funds appropriated in the annual Budget Act, to limit the percentage of undergraduate nonresident students enrolled at the University of California systemwide to 15.5% of total undergraduate student enrollment, and, until July 1, 2021, would prohibit any campus of the University of California where undergraduate nonresident student enrollment exceeds 15.5% from enrolling new undergraduate nonresident students. The bill would require a certain percentage of revenue generated from undergraduate nonresident enrollment to be directed to fund increased enrollment of undergraduate resident students, and would require the University of California to annually publish a report with specified information relating to undergraduate nonresident tuition and revenue.

The people of the State of California do enact as follows:

SECTION 1.  

Section 68052.1 is added to the Education Code,

68052.1.  

As a condition of receipt of funds appropriated in the
4annual Budget Act, and notwithstanding Section 68134, the
5University of California shall comply with all of the following:

6(a) The percentage of undergraduate nonresident students
7enrolled at the University of California systemwide shall not exceed
815.5 percent of total undergraduate student enrollment.

9(b) Until July 1, 2021, any campus of the University of
10California at which undergraduate nonresident enrollment exceeds
1115.5 percent of total student enrollment shall not enroll new
12undergraduate nonresident students.

13(c) An amount not less than 50 percent of the revenues in excess
14of the marginal cost of instruction generated from undergraduate
15nonresident enrollment shall be directed to fund increased
16enrollment of undergraduate resident students at all campuses of
17the university with undergraduate students.

18(d) The University of California shall annually publish a report
19that includes, but is not necessarily limited to, all of the following
20information:

21(1) The undergraduate nonresident tuition and fee level
22established at each campus.

23(2) The amount of revenues generated by undergraduate
24nonresident enrollment at each campus.

25(3) The method by which these revenues were distributed among
26the various campuses of the university.

27(4) For each campus, the purposes for which these revenues
28were expended, including, but not limited to, the number of
29California resident undergraduate students admitted pursuant to
30subdivision (c).
