An act to add Section 68052.1 to the Education Code, relating to the University of California.

Existing law expresses the intent of the Legislature that the University of California establish nonresident student tuition policies that are consistent with their resident student fee policies. The provisions are applicable to the University of California only if the Regents of the University of California act, by resolution, to make them applicable.

This bill would require the University of California, as a condition of receipt of funds appropriated in the annual Budget Act, to limit the percentage ofbegin delete undergraduateend delete nonresidentbegin insert undergraduateend insert students enrolled at the University of California systemwide to 15.5% of total undergraduate student enrollment,begin delete and, until July 1, 2021,end deletebegin insert andend insert would prohibit any campus of the University of California wherebegin delete undergraduateend delete nonresidentbegin insert undergraduateend insert student enrollment exceeds 15.5% from enrolling newbegin delete undergraduateend delete nonresidentbegin delete students.end deletebegin insert undergraduate students in excess of the number of new nonresident undergraduate students enrolled in the 2015-16 academic year.end insert Thebegin delete billend deletebegin insert bill, beginning in the 2017-18 academic year,end insert would require a certain percentage of revenue generated frombegin delete undergraduateend deletebegin insert newend insert nonresidentbegin insert undergraduate studentend insert enrollment to be directed to fund increased enrollment ofbegin delete undergraduateend delete residentbegin insert undergraduateend insert students, and would require the University of California to annually publish a report with specified information relating tobegin delete undergraduateend delete nonresidentbegin insert undergraduateend insert tuition and revenue.begin insert The bill would require the University of California to establish a policy to require each campus to admit only nonresident undergraduate students who exceed the academic qualifications of resident undergraduate students, as specified, and would require the University of California to annually report specified information to the Legislature to ensure compliance with the policy.end insert

The people of the State of California do enact as follows:

SECTION 1.  

Section 68052.1 is added to the Education Code,
2to read:

68052.1.  

As a condition of receipt of funds appropriated in the
4annual Budget Act, and notwithstanding Section 68134, the
5University of California shall comply with all of the following:

7 students enrolled at the University of California systemwide shall
8not exceed 15.5 percent of total undergraduate student enrollment.

19enrollment ofbegin delete undergraduateend delete residentbegin insert undergraduateend insert students at
20all campuses of the university with undergraduate students.

21(d) The University of California shall annually publish a report
22that includes, but is not necessarily limited to, all of the following
23information:

2fee level established at each campus.

3(2) The amount of revenues generated bybegin delete undergraduateend delete
4 nonresidentbegin insert undergraduateend insert enrollment at each campus.

5(3) The method by which these revenues were distributed among
6the various campuses of the university.

7(4) For each campus, the purposes for which these revenues
8were expended, including, but not limited to, the number of
9California resident undergraduate students admitted pursuant to
10subdivision (c).

(e) The University of California shall not be required to comply
12with the requirements of subdivisions (a) and (b) in any year in
13which the annual Budget Act provides less funding to support the
14University of California than was provided in the prior budget
15year.

(f) (1) By July 1, 2017, the University of California shall
17establish a policy regarding admission of nonresident
18undergraduate students to require that each campus of the
19University of California admit to that campus only nonresident
20undergraduate students who exceed the academic qualifications
21of resident undergraduate students admitted to that campus and,
22in that regard, would stand in the upper one-half of the resident
23undergraduate students admitted at that specific campus.

(2) The University of California shall report to the Legislature
25annually regarding actions taken to ensure compliance with this
26policy, including, but not limited to, the academic indicators used
27in the admission process, the median score of admitted resident
28undergraduate students for each indicator at each campus, and
29the number of admitted nonresident undergraduate students who
30scored below the resident median on each indicator at each
31campus.
