Existing law requires various state agencies to administer programs relating to water supply, water quality, and flood management in the Sacramento-San Joaquin Delta.
The bill would prohibit the construction of a peripheral canal, as defined, unless expressly authorized by an initiative voted on by the voters of California on or after January 1, 2017, and would require the Legislative Analyst’s Office to complete a prescribed economic feasibility analysis prior to a vote authorizing the construction of a peripheral canal.

The people of the State of California do enact as follows:
Chapter 1.5 (commencing with Section 115) is
2added to Division 1 of the Water Code, to read:
As used in this chapter, the following terms have the
4following meanings:
5(a) “Delta” means the Sacramento-San Joaquin Delta, as defined
6in Section 12220.
7(b) “Peripheral canal” means a facility or structure that conveys
8water directly from a diversion point in the Sacramento River to
9pumping facilities of the State Water Project or the federal Central
10Valley Project south of the Delta.
(a) Notwithstanding any other law, a peripheral canal
12shall not be constructed unless expressly authorized by an initiative
13voted on by the voters of California on or after January 1, 2017.
14(b) If an initiative described in subdivision (a) is placed on the
15ballot, prior to the election, the Legislative Analyst’s Office shall
16complete an economic feasibility analysis that includes both of
17the following:
18(1) The total cost of the project.
19(2) Expected impacts of the project on taxpayers, water
20ratepayers, and the General Fund.
Notwithstanding any other law, the construction and
22operation of a peripheral canal shall not diminish or otherwise
23negatively affect the water supply, water rights, or water quality
24for water users within the Delta watershed.
