Existing law authorizes a school district or school to provide a comprehensive program in first aid or cardiopulmonary resuscitation training, or both, to pupils and employees in accordance with specified guidelines. Existing law establishes a list of courses that a pupil in a school district is required to complete in grades 9 to 12, inclusive, in order to receive a diploma of graduation from high school.
This bill would require, commencing with the 2017-18begin delete academicend delete year, the governing board of a school district, and the governing body of a charter school, offering instruction to pupils in grades 9 to 12, inclusive, to provide instruction on performing cardiopulmonary resuscitationbegin delete and the use of an automated external defibrillatorend delete
as part of abegin delete courseend delete
requiredbegin delete for graduation,end deletebegin insert course,end insert as provided.begin insert The bill would encourage those entities to provide to pupils general information on the use and importance of an automated external defibrillator. The bill would require the State Department of Education to provide guidance on how to implement these provisions, including, but not limited to, who may provide instruction.end insert The bill would also make conforming changes to a related code section. By imposing additional requirements on school districts and charter schools, the bill would impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

The people of the State of California do enact as follows:
Section 51202 of the Education Code is amended
2to read:
The adopted course of study shall provide instruction
4at the appropriate elementary and secondary grade levels and
5subject areas in personal and public safety and accident prevention,
6including emergency first aid instruction, instruction in hemorrhage
7control, treatment for poisoning, resuscitation techniques, and
8cardiopulmonary resuscitation when appropriate equipment is
9available or when instruction is required pursuant to Section
1051225.6; fire prevention; the protection and conservation of
11resources, including the necessity for the protection of our
12environment; and health, including venereal disease and the effects
13of alcohol, narcotics, drugs, and tobacco upon the human body.
14The health instruction may include prenatal care
for pregnant
15women and violence as a public health issue.
Section 51225.6 is added to the Education Code, to
17read:
(a) Commencing with the 2017-18begin delete academicend deletebegin insert schoolend insert
19 year, the governing board of a school district, and the governing
20body of a charter school, offering instruction to pupils in grades
219 to 12, inclusive, shall provide instruction in performing
22cardiopulmonary resuscitation (CPR)begin delete and the use of an automated as part of a course required
23external defibrillator (AED)end deletebegin delete for
pursuant to
P3 1graduation pursuant to paragraph (1) of subdivision (a) Section
251225.3 or a course required by the local governing board of a
3school district for graduationend deletebegin delete paragraph (2) of begin insert
this article.end insert This instruction shall
4subdivision (a) Section 51225.3.end delete

6(1) An instructional programbegin delete developed by the American Heart
7Association or the American Red Cross, or an instructional
program
8that is nationally recognized and based on the most currentend delete
9onend insert national evidence-based emergency cardiovascular care
10guidelines for the performance ofbegin delete CPR and the use of an AED.end delete
11begin insert CPR, such as those developed by the American Heart Association
12or the American Red Cross.end insert
13(2) Training for pupils relative to the psychomotor skills
14necessary to perform CPR. For purposes of this paragraph,
15“psychomotor skills” means skills that pupils are required to
16perform as hands-on practice to support cognitive learning.
17(3) General information on the use and importance of an AED.
18The physical presence of an AED in the classroom is not required.

21schoolend insertbegin insert year, the department shall provide guidance on how to
22implement this section, including, but not limited to, who may
23provide instruction end insertpursuant to thisbegin delete section may be provided by a
24person who is certified in CPR and who is any of the following:end delete
25begin insert section. The department may consider an individual in any of the
26following
categories to provide instruction:end insert
27(1) A health care provider licensed pursuant to Division 2
28(commencing with Section 500) of the Business and Professions
29Code, the Osteopathic Initiative Act, as set forth in Chapter 8
30(commencing with Section 3600) of Division 2 of the Business
31and Professions Code, or the Chiropractic Initiative Act, as set
32forth in Chapter 2 (commencing with Section 1000) of Division
332 of the Business and Professions Code.
34(2) A person certified pursuant to the Emergency Medical
35Services System and the Prehospital Emergency Medical Care
36Personnel Act (Division 2.5 (commencing with Section 1797) of
37the Health and Safety Code).
38(3) A peace officer, as defined in Section 830 of the Penal Code.
39(4) A firefighter, defined as any regularly employed and paid
40officer, employee, or member of a fire department or fire protection
P4 1or firefighting agency of the State of California, a city, a county,
2a city and county, a district, or other public or municipal
3corporation or political subdivision of this state or member of an
4emergency reserve unit of a volunteer fire department or fire
5protection district.

7(B) A teacher shall not be required to be certified in CPR to
8facilitate, provide, or oversee instruction pursuant to this section
9for training that does not provide CPR certification.
10(6) An instructor certified to teach CPR by the American Red
11Cross or the American Heart Association, or an instructor certified
12to teach an instructional program that is nationally recognized and
13based onbegin delete the most currentend delete national evidence-based emergency
14cardiovascular care guidelines for the performance ofbegin delete CPR and begin insert CPR.end insert
15the use of an AED.end delete
16(c) If it is in accordance with the laws, rules, or regulations
17governing his or her profession, a person who provides instruction
18pursuant to subdivision (b) may apply the hours spent performing
19instruction toward fulfilling professional requirements for
20performing community service.
21(7) Any other provider of instruction in performing CPR, as
22determined by the department.
23(c) The governing board of a school district or the governing
24body of a charter school is encouraged to provide to pupils general
25information on the use and importance of an automated external
26defibrillator (AED). The physical presence of an AED in the
27classroom is not required.
28(d) The governing board of a school district or the governing
29body of a charter school may adopt regulations to implement this
30section.
31(e) (1) The governing board of a school district or the governing
32body of a charter school providing instruction in performing CPR
33orbegin insert information onend insert the use of an AED pursuant to this section is
34encouraged to use the most cost-effective means possible to
35implement that requirement.
36(2) This section shall not be construed to require the governing
37board of a school district or the governing body of a charter school
38to make any purchases, including, but not limited to, purchasing
39an AED.
P5 1(f) An entity providing, or overseeing the provision of,
2instruction in performing CPR or information on the use of an
3AED pursuant to this section may be exempt from civil liability,
4as applicable and except as specified, pursuant to Section 1714.2
5or 1714.21 of the Civil Code, respectively.
If the Commission on State Mandates determines that
7this act contains costs mandated by the state, reimbursement to
8local agencies and school districts for those costs shall be made
9pursuant to Part 7 (commencing with Section 17500) of Division
104 of Title 2 of the Government Code.
