An act to amend Sections 125107 and 125220 of the Public Utilities Code, relating to transit.

AB 1757, as amended, Waldron. North County Transit District.

Existing law provides for creation of the North County Transit District, with various powers and duties relative to the planning and operation of a transit system in north San Diego County. Existing law provides for the district to be governed by a board of directors, and requires compensation in the amount of $75 per day, not to exceed $300 per month, be paid to each board member or alternate for attending board meetings and authorizes similar, additional amounts for attending meetings of other public agencies.

This bill would instead provide for payments of $150 per meeting, not to exceed $750 per month, for board members, or alternates when acting on behalf of board members, for attending board meetings or meetings of other public agencies. The bill would thereby impose a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

SECTION 1.  

Section 125107 of the Public Utilities Code is

125107.  

Each member of the board, including an alternate
4member appointed pursuant to Section 125051 when acting on
5behalf of the member, shall be paid one hundred fifty dollars ($150)
6for each meeting of the board or other meeting of a governmental
7entity the member or alternate attends, but not to exceed seven
8hundred fifty dollars ($750) in any month, and the necessary and
9reasonable expenses in performing the duties as a board member.

SEC. 2.  

Section 125220 of the Public Utilities Code is amended
11to read:

125220.  

The district may make contracts and enter into
13stipulations of any nature whatsoever, either in connection with
14eminent domain proceedings or otherwise, including, but not
15limited to, contracts and stipulations to indemnify and save
16harmless, to employ labor, to contract with a private patrol operator
17licensed pursuant to Article 4 (commencing with Section 7583)
18of Chapter 11.5 of Division 3 of the Business and Professions
19Code, the county sheriff and municipal police departments within
20the areas described in Section 125052, and other transit
21development boards for security, police, and related services, and
22to do all acts necessary and convenient for the full exercise of the
23powers granted in this division.

SEC. 3.  

If the Commission on State Mandates determines that
25this act contains costs mandated by the state, reimbursement to

2pursuant to Part 7 (commencing with Section 17500) of Division
34 of Title 2 of the Government Code.

No reimbursement is required by this act pursuant to
5Section 6 of Article XIII B of the California Constitution because
6the only costs that may be incurred by a local agency or school
7district are the result of a program for which legislative authority
8was requested by that local agency or school district, within the
9meaning of Section 17556 of the Government Code and Section 6
10of Article XIII B of the California Constitution.
