Existing law provides that the Department of Transportation has full possession and control of the state highway system and associated property. Existing law authorizes the department to plan, design, and construct a system of safety roadside rests along state highways. The department, on or before January 1, 2018, shall
4update the Safety Roadside Rest Area Master Plan. In updating
5the plan, the department shall identify any changes to state or
6federal law that would be required in order to facilitate
7public-private partnerships for roadside rest areas that would be
8located outside of the highway right-of-way.

SECTION 1.  

Section 220 of the Streets and Highways Code
10 is amended to read:

220.  

(a) In designing safety roadside rests, the department
12shall design only those safety roadside rests that are reasonably
13economical and that will provide the motorist a place where he or
14she may stop for a short time during daytime and nighttime hours.
15The Legislature recognizes that the size of these safety roadside
16rests, together with the facilities therein, will differ according to
17location and potential use. The safety roadside rests may contain,
18among other things, depending upon the size and use thereof,
19parking places for vehicles, picnic tables, sanitary facilities,
20telephones, water, landscaping, tourist information panels, traveler
21service information facilities, and facilities for the distribution of
22 current news. The safety roadside rests shall not contain camping
23or recreational facilities.

24(b) The safety roadside rests located on that portion of Route 5
25in the Sacramento-San Joaquin Delta area may also contain
26displays and examples of California agriculture.
